ACCEPTABLE USE POLICY

This Acceptable Use Policy (“AUP”) applies to all hosting services, hosting solutions, cloud services, dedicated server services, domain name services, SSL certificates, and other services and solutions made available by SCALIBIT.COM, either directly or through one of its brands (“we” or “us”), as well as its suppliers and affiliates (collectively, “Services”).

The Services covered by this AUP include, but are not limited to:

  • Shared Web Hosting: cPanel Hosting, CWPpro Hosting, and WordPress Hosting

  • Virtual Machines: VPS, VDS, Dedicated Cloud Servers

  • Cloud Services: Cloud Hosting, Cloud Servers, Cloud Backup

  • Cloud Compute: Standard Performance, High Performance, High Frequency

  • Optimized Cloud Compute: General Purpose, CPU Optimized, Memory Optimized, Storage Optimized

  • Dedicated Servers: Enterprise-grade physical Dedicated Servers or Bare Metal configurations, available in multiple global locations

  • IP Address Services: IPv4 and IPv6 addresses assigned with Shared Web Hosting, Virtual Machines, Cloud Services, Cloud Compute Services, Optimized Cloud Compute Services, and Dedicated Servers or Bare Metal configurations

  • Domain Services: Domain Registration, Domain Renewal, Domain Transfer

  • Domain Name Plugins: Domain Protection / Whois Privacy, Premium DNS, etc.

  • SSL Certificates: Used with Hosting, Cloud, Dedicated Servers, and Domain Services

  • Software Services: OS licenses, Control Panels, and other Software Solutions

SCALIBIT reserves the right to introduce new services and solutions at any time. All current and future services provided by SCALIBIT are subject to this Acceptable Use Policy as updated from time to time.

This AUP is an integral part of your agreement with us and is incorporated by reference into the terms pursuant to which we provide you the right to access or use the Services.

YOUR ACCESS TO AND USE OF THESE SERVICES ARE GOVERNED BY THIS AUP. BY USING THE SERVICES, YOU AGREE TO BE BOUND BY THIS AUP. IF YOU DO NOT AGREE WITH ANY OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES.

1. GENERAL STATEMENT

The purpose of this AUP is to set forth the expected conduct of users of the Services and the types of actions and content that are contrary to our mission and philosophies. This AUP is intended to protect the Services and our employees, customers, and end users from improper, inappropriate, abusive or illegal activity. We may suspend or terminate your right to access and use the Services if, in our sole determination, we believe you have violated this AUP.

You agree to comply with all applicable local, state, and federal laws of the United States, as well as all foreign, national, and international laws, rules, and regulations — including the laws of the countries where SCALIBIT’s servers, data centers, and infrastructure are physically located — in connection with your use of the Services. SCALIBIT reserves the right to refuse service to anyone. Any material that, in our judgment, violates this AUP or any applicable law may be removed from our servers (or otherwise disabled), with or without notice. Failure to respond to an email from our Abuse Department within the specified time period in our notice to you may result in suspension or termination of the Services.

You are responsible for violations of this AUP by anyone using your account with your permission or on an unauthorized basis. You are also responsible for violations of this AUP by Your Users. Your use of the Services to assist another person in an activity that would violate this AUP if performed by you is a violation of the AUP. We may modify this AUP at any time by posting a revised version on the SCALIBIT Websites and/or Services.

Failure to abide by the terms of this AUP shall be grounds for immediate account suspension or termination, in some cases without notice, and forfeiture of all fees paid. Please note that the evolving nature of the Internet prevents us from including in this AUP all possible unacceptable uses of the Services. We reserve the right to determine, in our sole discretion, what other activities are unacceptable.

You are responsible for any and all content in and under your site, server, or account at all times. All services provided by SCALIBIT may be used for lawful purposes only.

SCALIBIT servers may be used for lawful purposes only. Transmission, storage, presentation, or distribution of any information, data, or material in violation of any applicable local, state, or federal laws of the United States, or any foreign, national, or international regulation — including the laws of the countries where SCALIBIT’s servers, data centers, and infrastructure are physically located — is strictly prohibited. Examples of such violations are provided below. This list is intended as a guide for you and your End Users and does not represent all possible unlawful uses of the Services.

SCALIBIT is not responsible for any claims resulting from the use of our Services. This includes, without limitation, sites or content that promote illegal activity, infringe intellectual property rights, or cause damage to SCALIBIT’s servers or any other system on the internet. Links to such materials are prohibited. This also includes, but is not limited to, adult content, pirated software or media, hacking programs or archives, copyrighted MP3 files, Warez, or any material protected by trade secrets or other statutory rights.

You may not use any of SCALIBIT’s Services for unlawful purposes. You agree to comply with all applicable local, state, and federal laws of the United States, as well as all foreign, national, and international laws, government rules, or regulations relevant to your use of the Services — including the laws of the countries where SCALIBIT’s servers, data centers, and infrastructure are physically located. You further agree that you will not be entitled to any refund of fees paid to SCALIBIT if corrective or enforcement action is taken due to your improper or illegal use of the Services.

It is your responsibility to ensure that your End Users comply with the terms of this AUP. Your failure to do so constitutes a violation of this AUP.

You are responsible for the activities of your agents, representatives, and end-users ("Users") and will ensure they abide by this AUP. The Services shall be used solely for legitimate business and commercial purposes, and you shall not use the Services for activities which, in SCALIBIT's sole discretion, may be illegal, offensive, abusive, or in a manner that interferes with or adversely affects the Services or use of the Services (including deliberate attempts to overload a system and broadcast attacks), or that would expose SCALIBIT to criminal or civil liability under applicable local, state, or federal laws of the United States, as well as any applicable foreign, national, and international laws and regulations, including the laws of the countries where SCALIBIT’s servers, data centers, and infrastructure are physically located.

2. ACCURATE INFORMATION

You are required to provide us with accurate information. This requirement includes information you provide to us during sign up, in communications with us, through trouble tickets and in our Control Panel. Failure to provide us with accurate information is a material breach of this contract and, if not cured within the time set out in your Terms of Service (TOS), will lead to Termination. We have no liability for losses incurred by you resulting from your failure to keep your information accurate and current.

3. ILLEGAL OR ABUSIVE ACTIVITY OR CONTENT

You may not use the Services for any unlawful or abusive purpose. The Services provided by SCALIBIT may only be used for lawful purposes and in compliance with all applicable laws. You agree to comply with all applicable local, state, and federal laws of the United States, as well as all foreign, national, and international laws, rules, and regulations — including the laws of the countries where SCALIBIT’s servers, data centers, and infrastructure are physically located — in connection with your use of the Services. SCALIBIT reserves the right to refuse service to anyone at its sole discretion. Any material or conduct that, in SCALIBIT’s judgment, violates this Acceptable Use Policy in any manner may result in suspension or termination of the Services or removal of content with or without notice.

You may not use, or encourage, promote, facilitate, or instruct others to use, the Services for any illegal, criminal, unlawful, harmful, fraudulent, infringing, or offensive use or enterprise, or to transmit, store, display, distribute, or otherwise make available information or content (including User Content) that is illegal, unlawful, harmful, fraudulent, infringing, or offensive. Prohibited activities or content include:

  • 3.1 Illegal, Harmful, or Fraudulent Activities. Any activities that are illegal, tortious, that violate the rights of others, or that may be harmful to others, our operations, or reputation, including disseminating, promoting, or facilitating child pornography, offering or disseminating fraudulent goods, services, schemes, or promotions, make-money-fast schemes, ponzi and pyramid schemes, phishing, or pharming.

  • 3.2 Infringing Content and/or Use. Content that infringes or misappropriates the intellectual property or proprietary rights of others, including unauthorized disclosures of private information, or taking information directly from SCALIBIT and/or our Users, and using it for your own personal or business purposes without permission or proper attribution. You agree NOT to attempt to resell SCALIBIT’s products and/or access to the Services without our written permission.

  • 3.3 Offensive Content. Content that is harmful to minors in any way, defamatory, libelous, obscene, abusive, threatening, discriminatory, harassing, invasive of privacy, false, intentionally misleading, patently offensive, or otherwise objectionable, including content that constitutes child pornography, relates to bestiality, depicts non-consensual sex acts or that promotes racism, bigotry, hatred, religious intolerance, misogyny, or physical harm of any kind against any group, individual or animal.

  • 3.4 Harmful Content. Content or other computer technology that may damage, interfere with, surreptitiously intercept, or expropriate any system, program, or data, including viruses, Trojan horses, worms, time bombs, or cancelbots.

  • 3.5 False Content. Submitting any content or information that falsely states, impersonates or otherwise misrepresents your identity, including but not limited to misrepresenting your current or previous qualifications, or your affiliations with a person or entity, past or present, or assuming another’s identity.

  • 3.6 Illegal or Fraudulent Use. Using SCALIBIT Services, servers, or IP addresses to facilitate, conceal, or otherwise enable illegal or fraudulent activity, including but not limited to identity theft, payment fraud (e.g., using stolen or cloned credit cards), operating illegal marketplaces, or processing proceeds of unlawful activity, is prohibited under all applicable local, state, federal, and international laws, including the laws of the countries where SCALIBIT’s servers, data centers, and infrastructure are physically located.

  • 3.7 Anonymization Services for Unlawful Use. Provisioning, operating, or providing VPNs, proxies, or anonymization services that conceal identity for illegal, abusive, or fraudulent purposes is strictly prohibited. This includes but is not limited to the use or operation of such Services or IP addresses for the purpose of hiding or masking your real identity or IP address, or for facilitating illegal, abusive, or fraudulent activities.

    The use of SCALIBIT’s Services, servers, or any IP addresses assigned to you for VPN, proxy, anonymization, or any other obfuscation purposes that facilitate, conceal, or enable illegal, fraudulent, or abusive activity — including but not limited to fake purchases, stolen or cloned credit card usage, identity theft, payment fraud, defamation, unauthorized access attempts, operation of illegal marketplaces, or processing the proceeds of unlawful activity — is strictly prohibited.

    Provisioning or operating VPN, proxy, or anonymization services that conceal identity for illegal, abusive, or fraudulent purposes is also expressly prohibited, including but not limited to hiding, masking, obfuscating, or otherwise concealing the real IP address or location of users or endpoints. Violations may result in immediate account suspension, IP revocation, or permanent termination without refund and may be reported to competent authorities.

    SCALIBIT reserves the right to cooperate fully with authorized public institutions and law enforcement agencies in relation to such incidents and to provide relevant customer, service, or IP-related information upon receipt of an official and verifiable request. Any IP addresses or services found to be involved in illegal VPN, proxy, or anonymization activity may be immediately suspended and reported to competent authorities without prior notice.

    3.8 Illegal or Fraudulent Activity. Using SCALIBIT Services, servers, or IP addresses to facilitate, conceal, or otherwise enable illegal or fraudulent activity — including but not limited to identity theft, payment fraud (for example, use of stolen or cloned credit cards), operating illegal marketplaces, or processing proceeds of unlawful activity — is strictly prohibited.

  • Law Enforcement Cooperation.

    In cases involving illegal activities, fraudulent websites, or any content that violates applicable laws, SCALIBIT may cooperate in good faith with competent authorities — including but not limited to Law Enforcement Agencies, Prosecutors, or Courts — and provide relevant customer identification data, service details, or technical and infrastructure-related information (limited to data legitimately available within SCALIBIT’s own systems, such as assigned IP addresses, service configuration details, or node allocation records) upon receipt of an official, lawful, and verifiable request, as required by applicable local, state, and federal laws of the United States, and by foreign, national, or international regulations in jurisdictions where SCALIBIT or its verified data center partners operate.

    You may use SCALIBIT Services solely for lawful purposes. Any unlawful use is strictly prohibited. You are fully responsible for all activities carried out through your Services and assigned IP addresses. In the event of any criminal investigation or legal process, SCALIBIT reserves the right to cooperate with competent authorities under applicable local, state, federal, and international laws to the minimum extent necessary to comply with its legal obligations.

    4. PROHIBITED USE OR CONTENT

    You are responsible for the content you upload or transmit using our products and services.

    The following list of prohibited activities is not exhaustive, but is intended as a guide for your use of our products and services.

    You may not use the Services to publish content or engage in activity that is illegal under applicable law, that is harmful to others, or that would subject SCALIBIT to liability, including, without limitation, in connection with any of the following, each of which is prohibited under this AUP.

    Any of the following violations will result in prompt suspension and/or termination of your Service.

    Customers must ensure that their use of SCALIBIT Services complies with all applicable local, state, and federal laws of the United States, as well as all applicable foreign, national, and international laws and regulations — including but not limited to data protection, export control, telecommunications, and cybercrime regulations, and including the laws of the countries where SCALIBIT’s servers, data centers, and infrastructure are physically located. SCALIBIT reserves the right to suspend or terminate Services that violate applicable law or are subject to a lawful investigation by competent authorities.

    4.1 Unacceptable Material On Our Servers Include Without Limitation:

    • Excessive resource, CPU and RAM, abuse causing degradation of server performance;

    • Topsites.

    • Storing personal or sensitive information, including without limitation, "Protected Health Information" as defined under the U.S. Health Insurance Portability and Accountability Act (“HIPAA”);

    • Hosting or transmitting pornographic material;

    • Hosting or transmitting child pornography, child erotica or material depicting bestiality, or written descriptions of any of these activities;

    • Hosting, distributing or linking to child sexual abuse material (CSAM) or content that is harmful to minors (CSAM will be suspended immediately without notice and reported to law enforcement or the National Center for Missing and Exploited Children);

    • Content that depicts minors engaged in any activity of a sexual nature or which may otherwise harm minors;

    • Activities that mislead or deceive minors into viewing sexually explicit material;

    • Content or actions that attempt to defraud members of the public in any way (for example, "phishing" sites);

    • Escort sites, escort listings, or escort services;

    • Promoting or facilitating prostitution or sex trafficking;

    • Any website related to Cannabis, CBD is strictly forbidden.

    • IRC Scripts/Bots.

    • IRCD (irc servers).

    • Importing or exporting any material prohibited by U.S. law;

    • Proxy Scripts/Anonymizers (Operating Proxy Scripts or Anonymizers).

    • Using torrent clients, Peer-to-Peer (P2P) file-sharing software, or running Torrent trackers, Torrent portals, or similar software.

    • Running applications that generate illegal traffic on any network.

    • Engaging in spam activities, DDoS attacks, or any other abusive behavior.

    • Image Hosting Scripts (similar to Photobucket or Tinypic).

    • AutoSurf/PTC/PTS/PPC sites.

    • IP Scanners.

    • Bruteforce Programs/Scripts/Applications.

    • Mail Bombers/Spam Scripts.

    • Banner-Ad services (commercial banner ad rotation).

    • File Dump/Mirror Scripts (similar to rapidshare).

    • Commercial Audio Streaming (more than one or two streams).

    • Escrow/Bank Debentures.

    • High-Yield Interest Programs (HYIP) or Related Sites.

    • Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme).

    • Sale of any controlled substance without prior proof of appropriate permit(s).

    • Prime Bank Programs.

    • Lottery/Gambling Sites.

    • Facilitating or advertising gambling, or any facsimile of gambling;

    • MUDs/RPGs/PBBGs.

    • Hacker focused sites/archives/programs.

    • Facilitating, encouraging or providing assistance to any activity that engages in hacking, spreading viruses or compromises security;

    • Promoting or facilitating violence or terrorist activities;

    • Sites promoting illegal activities.

    • Facilitating, encouraging or providing assistance to any activity that engages in defamation, slander, hate speech or any similar act;

    • Monitoring the communications of others, including, but not limited to, sniffing;

    • Forums and/or websites that distribute or link to warez/pirated/illegal content.

    • Bank Debentures/Bank Debenture Trading Programs.

    • Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com).

    • Mailer Pro.

    • Actions that might subject us to unfavorable regulatory action, liability for any reason, or adversely affect our public image, reputation or goodwill, as determined by us in our sole and exclusive discretion;

    • Soliciting the performance of or directly facilitating any illegal activity;

    • Instructing others in prohibited activities; and/or

    • Undermining the stability of our network, our other customers, or the Internet as a whole.

    • Storing a large archive of images, audio files, multimedia files, backups within the hosting account.

    • Collecting or harvesting or permitting anyone else to collect or harvest any Personally Identifiable Information (PII) about any User or entity without their express consent.

    • Push button mail scripts.

    • Broadcast or Streaming of Live Sporting Events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, WWF, etc).

    • Tell-a-Friend Scripts.

    • Anonymous or Bulk SMS Gateways.

    • Crypto coin mining or any crypto coin related activities.

    • PayDay Loan Sites (including any site related to PayDay loans, PayDay loan affiliate programs, etc).

    • Hacking, phishing, spamming, scamming, identity theft, fraud, forgery, deception, virus or malware distribution, network attacks, and interference with any other user’s use of the Services.

    • The unauthorized access, monitoring, collection, or use of data, systems or networks.

    • Transmitting, distributing or storing illegal or fraudulent information or material or information or material that will infringe or otherwise violate any privacy, intellectual property, publicity or other personal rights including, any copyright, patent, trademark, trade secret or other proprietary right.

    • Engaging in offensive activities such as harassment or transmitting or distributing content that is inappropriate, obscene, defamatory, threatening, abusive, that advocates violence, or that violates a law, regulation, or public policy.

    • Content that is hateful, defamatory, derogatory or bigoted based on racial, ethnic, political grounds or which otherwise may cause or incite injury, damage or harm of any kind to any person or entity;

    • Sending Unsolicited Bulk Email (“UBE”, “spam”). The sending of any form of Unsolicited Bulk Email through SCALIBIT’s servers is prohibited. Likewise, the sending of UBE from another service provider advertising a web site, email address or utilizing any resource hosted on SCALIBIT’s servers, is prohibited. SCALIBIT accounts or services may not be used to solicit customers from, or collect replies to, messages sent from another Internet Service Provider where those messages violate this Policy or that of the other provider.

    • Bulk email blasts or newsletters, that exceed the hourly email limits, from SCALIBIT’s servers is prohibited.

    • Purchasing lists of email addresses from 3rd parties for mailing to from any SCALIBIT-hosted domain, or referencing any SCALIBIT account, is prohibited.

    • Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks.

    • Operating an account on behalf of, or in connection with, or reselling any service to, persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) database at www.spamhaus.org/rokso.

    • Unauthorized attempts by a user to gain access to any account or computer resource not belonging to that user (e.g., “cracking”).

    • Content or actions that violate any applicable local, state, or federal laws of the United States, or any applicable foreign, national, and international laws or regulations;

    • Content that is threatening or invades another person's privacy or property rights or is otherwise in breach of any duty owed to a third party;

    • Content or actions that infringe the trademark, copyright, patent rights, trade secret or other intellectual property rights, or any other legal rights of SCALIBIT or any third party;

    • Content or actions that promote, are involved in or assist in, the conduct of illegal activity of any kind or promote business opportunities or investments that are not permitted under applicable law;

    • Content that advertises or offers for sale any goods or services that are unlawful or in breach of any national or international law or regulation;

    • Content that advertises or offers for sale any goods or services the Advertiser does not have the legal right to sell; or

    • Content that links to or is associated with the sale, promotion, or distribution of prescription medication that violates any applicable local, state, or federal laws of the United States, or any applicable foreign, national, and international laws or regulations, including the laws of the countries where SCALIBIT’s servers, data centers, and infrastructure are physically located.

    • Hosting online pharmacies.

    • Promoting violence or injury.

    • Using defamatory, threatening or abusive language.

    • Hosting gambling, or similar activities such as HYIP (High Yield Investment Programs), Ponzi schemes or pyramid schemes.

    • Violations of U.S. export control laws.

    • You will not use the Services to circumvent or violate export control or international sanctions laws, including OFAC, SDN, or similar regulatory restrictions.

    • Using SCALIBIT Services, servers, or IP addresses for money laundering, terrorist financing, or any financial crime is strictly prohibited and will be reported to competent authorities.

    • Hosting, distributing, or controlling botnets, malware, phishing pages, ransomware, or other command-and-control infrastructure intended to exploit or harm others.

    • You will not reverse engineer, decompile, or attempt to gain unauthorized access to SCALIBIT APIs, nor use APIs in a manner that circumvents payment, quotas, or customer restrictions.

    • Violation of intellectual property rights of others.

    • Forging, misrepresenting, omitting or deleting message headers, return mailing information, or internet protocol addresses to conceal or misidentify the origin of a message

    • Creating or sending Internet viruses, worms or Trojan horses, flood or mail bombs, or engaging in denial of service attacks.

    • Hacking, and/or subverting, or assisting others in subverting, the security or integrity of SCALIBIT's services or systems.

    • Soliciting the performance of any illegal activity, even if the activity itself is not performed.

    • Directly facilitating violation of a law or regulation and/or instructing others in prohibited activities.

    • Any other material SCALIBIT judges to be threatening or obscene.

    In addition, you and your Users must comply with all applicable laws, rules and regulations related to your use of the Services, specifically including data protection and privacy laws, as well as laws relating to unsolicited commercial electronic messages.

    If you are in violation of any of the above provisions or are engaged in any other misleading or illegal activities, you agree that we may suspend, cancel, transfer or modify your use of services or individual domain names without prior notice to you.

    No fees will be refunded if any of the activities mentioned above, or any other inappropriate or illegal activities, result in the suspension, transfer or other such loss your services.

    IP Address Responsibility. Customers are solely responsible for all activities conducted through their assigned IP addresses. Any abuse or illegal action originating from assigned IPs shall be deemed the responsibility of the customer of record.

    Verification and Compliance. SCALIBIT may request government-issued identification or business registration documents to verify user identity, prevent fraud, and ensure compliance with applicable regulations. Failure to provide such verification upon request may result in suspension or termination of Services.

    Law Enforcement Cooperation.

    In cases involving illegal activities, fraudulent websites, or any content that violates applicable local, state, or federal laws of the United States, or any applicable foreign, national, and international laws and regulations in jurisdictions where SCALIBIT or its verified data center partners operate, SCALIBIT may cooperate in good faith with competent authorities — including but not limited to Law Enforcement Agencies, Prosecutors, or Courts — and provide relevant customer identification data, service details, or technical and infrastructure-related information (limited to data legitimately available within SCALIBIT’s own systems, such as assigned IP addresses, service configuration details, or node allocation records identifying the hosting node of a Customer’s service) upon receipt of an official, lawful, and verifiable request, as required by applicable law.

    This cooperation may extend to competent international authorities or cross-border law-enforcement agencies acting under applicable international law or mutual legal-assistance frameworks (MLATs), in accordance with data-protection and privacy regulations.

    4.2 By Using Any Service Provided By SCALIBIT You Agree That:

    • You will not violate any applicable local, state, or federal laws of the United States, or any applicable foreign, national, and international laws, regulations, ordinances, rules, or requirements of any competent authority or regulator, including the laws of the countries where SCALIBIT’s servers, data centers, and infrastructure are physically located.

    • You will not use SCALIBIT Services, servers, or IP addresses for VPN, proxy, or anonymization purposes, or to conceal identity or facilitate any illegal or fraudulent activity.

    • You will not transmit any unsolicited commercial or bulk email. You will not engage in any spamming or Mail Bombing activities.

    • All your outgoing email messages containing advertising will include an automated opt out.

    • You will not make any inappropriate communication to any Newsgroup, Mailing List, Chat Facility, or another Internet Forum.

    • You will not make, attempt or allow any unauthorized access to SCALIBIT and/or third-party website(s), server(s), or hosting accounts and/or services.

    • You will not allow any remote code execution of malicious software.

    • You will not cause denial of service attacks, port scans or other endangering and invasive procedures against SCALIBIT servers and facilities or the servers and facilities of other network hosts or Internet users.

    • You will not forge the signature or other identifying mark or code of any other person or engage in any activity (including "spoofing") to attempt to deceive other persons regarding the true identity of the User (excluding the use of anonymous remailers or Internet nicknames).

    • You will not display, store, distribute or otherwise make available any content or material that you are not authorized to, whether because prohibited by law, agreement or other reason. This includes but is not limited to copyrighted music, video, photos, designs, files, copyrighted software, personally identifiable or protected confidential information, trade secrets, etc.

    • You will not impersonate any person or entity.

    • You may host websites related to high-risk activities where the interruption or malfunction of the Services could lead to serious consequences, including but not limited to personal injury, death, environmental damage, etc., only after receipt of our explicit consent. For such websites, you must receive confirmation from us that you can use the Services before submitting your Order. Examples of high risk activities include but are not limited to nuclear facilities, air traffic control, life and health support, etc.

    • You will not harm or seek to harm minors in any way.

    • You will not host or operate an audio and/or video streaming service.

    • You will not host websites that make use of cryptopools/contain mining scripts, promote cryptocurrency money-making schemes, are crypto exchange and crypto airdrop sites.

    4.3 You May Not Host Any Website, Content, Links, or Advertisements That:

    • Infringe on any copyright, trademark, patent, trade secret, or other proprietary rights of any party.

    • Promote hatred or discrimination against any social, ethnic, religious, or other group.

    • Contain viruses, Trojan horses, worms, time bombs, ransomware, spyware, adware, scareware, corrupted files, or any other malicious software or programs that may interfere with, limit, or damage the functionality of any software, hardware, or equipment.

    • Contain illegal or hacking/phreaking software (Warez).

    • Distribute copyrighted software that is not freely available without cost. This includes, but is not limited to, ROMs, ROM emulators, and MPEG Layer 3 files (MP3s).

    • Operate any kind of proxy server or other traffic-relaying programs.

    • Promote money-making schemes, multi-level marketing, or similar activities.

    • Contain torrent trackers, torrent portals, or similar software.

    • Facilitate or operate peer-to-peer (P2P) network systems and file-sharing systems.

    • Contain adult content, pornography, obscene material, unlawfully harassing content, or any material related to child abuse or sex-related merchandising.

    • Store or share personal data, private information, images, photos, videos, or any other identifying information of any third party, including minors, without their consent (or parental consent in the case of a minor).

    • Contain data or material that is unlawful, abusive, threatening, harassing, or defamatory.

    • Distribute fake news, misleading information, or content that is untruthful or inaccurate.

    • Promote, encourage, or provide any kind of support for violence or terrorism.

    4.4 Zero Tolerance Adult Content Policy

    SCALIBIT maintains a strict zero-tolerance policy for adult content. Any material considered “adult” in nature is strictly prohibited on our servers. This includes, but is not limited to, any media containing nudity, partial nudity, sexually explicit material, or any other content deemed inappropriate or adult-oriented at SCALIBIT’s sole discretion. Violation of this policy will result in immediate termination of the Service without refund.

    5. NO SPAM, EMAIL OR OTHER MESSAGE ABUSE

    You agree to comply at all times with our Anti-Spam Policy and acknowledge that compliance with this section is a material condition of your use of SCALIBIT Services. Any violation of this section constitutes a material breach of the Agreement and may result in immediate suspension or termination of Services without refund.

    You must not distribute, publish, send, or facilitate the sending of unsolicited or bulk email, messages, promotions, advertising, or solicitations (including “spam”) of any kind, whether commercial or informational. This includes any communication that is not requested by the recipient or that violates applicable anti-spam laws, such as the CAN-SPAM Act, the EU ePrivacy Directive, or equivalent regulations in your jurisdiction.

    You shall not alter or obscure email headers, forge sender identities, or use false or misleading header information. You must not collect replies to messages sent from another internet service provider if those messages violate this AUP or the acceptable use policy of that provider. You will not take any action which directly or indirectly results in any of SCALIBIT’s IP addresses or domains being listed on any abuse or blocklisting database (e.g., Spamhaus, Barracuda, Proofpoint, UCEPROTECT, RIPE NCC Abuse, or any other reputable anti-abuse database).

    You must use reasonable efforts to secure any device, system, or network within your control against being used in violation of laws or this AUP. This includes maintaining up-to-date security patches, antivirus protection, firewall rules, and ensuring that no systems under your control operate as open relays, open proxies, or allow unauthorized third-party mail relay.

    You must comply with all applicable laws and regulations governing bulk or commercial email in your jurisdiction. In addition, your bulk or commercial email must meet the following minimum requirements:

    • You must have a clear and accessible privacy policy or similar disclosure posted for each domain associated with the mailing.

    • You must maintain systems to track and handle anonymous complaints effectively.

    • You must not obscure or falsify the source of your email in any manner.

    • You must provide and monitor a valid abuse contact (e.g., abuse@yourdomain.com) and respond promptly to abuse complaints.

    • Recipients must have given verifiable consent to receive email through an affirmative opt-in process, and you must be able to provide proof of consent within 48 hours upon request by SCALIBIT or an affected recipient.

    • You must verify that the person giving consent owns or controls the email address for which the consent is given.

    • All messages must clearly identify the sender, include a physical contact address, and contain a working opt-out mechanism that functions within 48 hours.

    • You must honor revocations of consent promptly and cease further messages to that recipient within 48 hours.

    You must maintain valid SPF, DKIM, and DMARC records for all domains used in outbound messaging, ensuring proper authentication and compliance with modern email delivery standards. Failure to implement or maintain these mechanisms may result in message rejection, deliverability degradation, or suspension of email privileges.

    Proper reverse DNS (rDNS/PTR) configuration must also be maintained for all mail-sending IPs. Failure to maintain valid PTR records may result in message rejection, degraded reputation, or suspension of outbound email privileges.

    The following activities are strictly prohibited:

    • Sending Unsolicited Commercial Email (UCE) or Unsolicited Bulk Email (UBE).

    • Using SCALIBIT’s Services to send or relay messages through unauthorized servers or compromised systems.

    • Forging mail headers, signatures, or other identifiers to deceive recipients.

    • Operating or promoting services via spam or other abusive messaging (“spamvertising”).

    • Running open mail relays, open proxies, or misconfigured mail systems that allow unauthenticated relay.

    • Engaging in phishing, fraudulent, or deceptive messaging of any kind (including SMS, instant messages, or social channels).

    • Participating in any activity that leads to IP reputation loss or blacklisting.

    These email policies apply to all messages sent using SCALIBIT Services or any message sent by or on behalf of you that directly or indirectly references a site, service, or system hosted through SCALIBIT infrastructure — including transactional, promotional, or informational messages sent through any application, script, SMTP relay, or third-party integration.

    Enforcement and Remedies.

    SCALIBIT enforces a strict zero-tolerance policy for spam, abuse, or messaging activity that affects the stability, security, or reputation of its network. If SCALIBIT determines that any service is used for or associated with spam or abuse, immediate action may be taken, including rate limiting, filtering, null-routing, suspension, or termination of affected services without prior notice. Such action may extend to any linked accounts or related resources.

    Customers will typically be notified via their registered email or Client Area and may be required to confirm cessation of the abuse and implement corrective actions. SCALIBIT may charge a non-refundable reactivation fee before restoring any suspended service. Repeat violations or severe abuse may result in permanent termination without refund.

    Liquidated Damages and Blacklist Remediation.

    If actual damages resulting from spam or abuse cannot be reasonably calculated, you agree to pay SCALIBIT liquidated damages of $500.00 or $1.00 per spam message or abuse event, whichever is greater. In addition, a blacklist or remediation fee starting at $500.00 may be charged to cover delisting costs, engineering time, or third-party fees. You are solely responsible for maintaining the reputation of your assigned IP addresses and domains.

    Deliverability, blocklisting (RBL), and overall IP reputation management are the sole responsibility of the customer. SCALIBIT is not liable for any deliverability loss, degraded IP reputation, or third-party blocklisting resulting from customer behavior, misconfiguration, or abuse.

    SCALIBIT disclaims all liability for loss of deliverability, IP reputation degradation, or blocklisting resulting from customer behavior or third-party blacklists. Remediation does not guarantee successful delisting or future deliverability.

    Legal Cooperation.

    SCALIBIT reserves the right to preserve logs, investigate complaints, and cooperate fully with law enforcement, judicial authorities, and competent regulatory bodies. Customer information or IP usage data may be disclosed upon receipt of valid and binding legal requests, in accordance with applicable privacy and data protection laws.

    In cases where IP addresses are provided by SCALIBIT’s upstream network providers or verified data center partners, SCALIBIT reserves the right to coordinate with those providers to mitigate abuse, revoke allocations, or suspend affected IPs or services without prior notice.

    All assigned IP addresses and messaging systems must be used in compliance with this AUP, all applicable local, state, and federal laws of the United States, as well as all applicable foreign, national, and international laws and regulations, including the laws of the countries where SCALIBIT’s servers, data centers, and infrastructure are physically located, and any relevant Regional Internet Registry (RIR) policies. Any misuse may result in immediate suspension or revocation of IP assignments and related services.

    5.1 IP ADDRESS USAGE AND RESPONSIBILITY.

    All IP addresses assigned to customers under SCALIBIT Services are allocated and managed either directly by SCALIBIT, by its upstream network providers, or through verified data center partners where SCALIBIT operates rented or colocated infrastructure. Such assignments represent temporary, non-transferable usage rights granted solely for the duration of the active service term and do not constitute ownership. All assigned IPs remain under the administrative and operational control of SCALIBIT and/or its verified data center partners.

    Customers must utilize at least eighty percent (80%) of assigned IPv4 addresses within thirty (30) days of allocation and maintain compliance with applicable Regional Internet Registry (RIR) utilization and justification requirements. Under-utilized, abused, or unjustified allocations may be reclaimed without refund to ensure compliance with RIR and SCALIBIT’s internal IP Address Services Policy.

    Customers are fully responsible for all activities originating from their assigned IP space, including any actions by employees, resellers, contractors, or clients using their systems. Prohibited uses include, but are not limited to: spamming, phishing, malware distribution, brute-force or denial-of-service (DoS/DDoS) attacks, port scanning, proxy/VPN tunneling, anonymization, or any unlawful or unethical activity. Misuse may result in immediate suspension, IP revocation, or termination of related services without refund and may be reported to competent authorities or upstream providers when required to maintain network integrity.

    Reverse DNS (rDNS/PTR): rDNS functionality is available only for infrastructure-based services that include dedicated IP allocations and must follow SCALIBIT’s rDNS naming and verification policy. Shared Web Hosting environments are excluded from rDNS customization unless otherwise specified. rDNS operations are performed under the administrative and operational control of SCALIBIT and its verified data center partners.

    SCALIBIT and its verified data center partners retain full administrative and operational control over all IP address space assigned, routed, or announced through their networks. Failure to comply with IP management, justification, or abuse policies may result in immediate suspension, reassignment, or permanent termination of affected services without refund. All IP usage must comply with SCALIBIT’s Acceptable Use Policy, this Agreement, and applicable law.

    5.2 Email Deliverability and Authentication Responsibility.

    Shared Web Hosting services (cPanel Hosting, CWPpro Hosting, WordPress Hosting) include standard email functionality as a complementary feature of the hosting package. When a hosting account is provisioned, the system automatically generates DNS, SPF, and DKIM records for the associated domain name to facilitate basic email authentication and outbound delivery. However, the Customer is solely responsible for ensuring that these records are correctly propagated, valid, and actively maintained — particularly when the domain uses external DNS providers (e.g., Cloudflare, external registrars, or third-party DNS systems).

    SCALIBIT does not automatically create or manage DMARC records, which are required by certain mail providers (including Google, Microsoft, and Yahoo) for optimal deliverability and authentication compliance. The Customer must manually configure DMARC and any additional DNS-based authentication policies if required by their email usage or third-party mail provider standards.

    While SCALIBIT maintains proper mail server hygiene and implements SPF/DKIM signing at the server level, it does not guarantee deliverability to specific recipients or third-party mail systems. Email transmission and delivery may be affected by factors beyond SCALIBIT’s control, including but not limited to: the message content (subject lines, body text, attachments, signatures, or embedded links), the reputation or filtering policies of external mail providers (e.g., Microsoft Outlook/Hotmail, Google Gmail, Yahoo, Yandex, Zoho, ProtonMail, or mail systems hosted by other hosting providers), and the recipient’s configuration or spam filtering mechanisms. SCALIBIT shall not be held liable for emails delayed, rejected, or filtered as spam due to such external or content-based factors.

    SCALIBIT maintains global outbound IP reputation monitoring; however, Customers share outbound mail infrastructure in Shared Hosting environments. In the event that a Customer’s domain or outbound IP becomes blacklisted (e.g., by Spamhaus, Barracuda, or similar RBL/DBL providers), SCALIBIT may take immediate corrective action including IP reassignment, rate limitation, or temporary suspension to protect overall mail system integrity. SCALIBIT is not responsible for third-party blacklistings caused by Customer activity or content.

    Email functionality under Shared Web Hosting is provided on a best-effort basis and is intended for normal website-related communication only. Bulk mailing, mass marketing, or automated newsletter systems must not be operated from shared environments. Such activities are subject to the Anti-Spam Policy and may result in immediate suspension or termination without refund.

    Customers who purchase a Dedicated IP address under Shared Web Hosting plans may use that IP for outbound mail delivery. This configuration provides sender-level isolation but remains part of the shared mail infrastructure. All email routing, delivery, and filtering processes continue to operate under SCALIBIT’s shared hosting framework and outbound policies. A Dedicated IP does not convert a Shared Hosting account into a separate or managed mail service, and all general email usage restrictions under this Policy remain fully applicable.

    Outbound email connections initiated from Customer devices (such as desktop mail clients, mobile devices, or remote networks) may originate from dynamic public IP addresses assigned by third-party Internet Service Providers (ISPs). These sender IPs are not part of SCALIBIT’s infrastructure and may occasionally appear in external reputation or blacklist databases (e.g., Spamhaus PBL) unrelated to our network. Such listings or reputation issues can occur even when authentication through SCALIBIT’s mail servers succeeds, and may negatively affect message deliverability or cause messages to be filtered by recipient systems. SCALIBIT cannot control or guarantee delivery outcomes when an external ISP IP is listed, blocked, or flagged by reputation systems. Customers are responsible for using secure, authenticated SMTP connections and ensuring that their local network or ISP-assigned IP addresses maintain good reputation standing and are not listed in public databases.

    For all other SCALIBIT infrastructure services — including Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute Services (Standard Performance, High Performance, High Frequency), Optimized Cloud Compute Services (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), and Dedicated Servers (Dedicated Servers or Bare Metal) — email configuration, security, and deliverability are the sole responsibility of the Customer.

    SCALIBIT provides initial server provisioning (including OS installation and root credential delivery) but does not manage or maintain post-deployment configurations. Customers are responsible for setting up and maintaining their own mail transfer agents (MTAs), including but not limited to: rDNS (PTR) records, SMTP configuration, SPF/DKIM/DMARC records, TLS/SSL certificates, and IP reputation management. Any issues related to outgoing or incoming email delivery, spam reputation, or blocklisting (RBL/DBL listings) are the Customer’s sole responsibility.

    Reverse DNS (rDNS/PTR) configuration is not automatically applied by SCALIBIT. Customers may request rDNS updates for their assigned IP addresses via the Customer Portal or support ticket, subject to validation and compliance review. Incorrect or fraudulent rDNS records (e.g., impersonation of third-party domains) may result in suspension or IP revocation.

    SCALIBIT does not monitor, manage, or maintain Customer-operated mail systems, and is not responsible for undelivered or filtered messages caused by misconfiguration, third-party reputation systems, or remote mail server policies.

    Support for mail-related configuration (e.g., initial MTA setup, mail service configuration, or port management) may be offered by SCALIBIT as a paid administrative service upon Customer request. Such assistance is limited to initial setup, configuration, or verification tasks. Ongoing maintenance, reputation management, or monitoring remain the sole responsibility of the Customer.

    When Customers use external mail clients (such as Outlook, Thunderbird, or mobile applications) to connect to their self-managed mail servers, outgoing messages may include the public IP address of the Customer’s local Internet connection (assigned by their Internet Service Provider, or ISP). These originating IPs are outside SCALIBIT’s control and may occasionally appear in third-party reputation databases or dynamic IP lists (e.g., Spamhaus PBL). SCALIBIT cannot guarantee or influence deliverability outcomes affected by such external ISP addresses, and the Customer remains fully responsible for maintaining their own network reputation and mail compliance.

    In addition, Customers must ensure that no spam, bulk, or unsolicited email is transmitted from their servers. If SCALIBIT detects spam or abuse activity — including but not limited to unsolicited bulk email, high complaint rates, or IP blacklisting — the affected Service may be throttled, suspended, or terminated without prior notice in accordance with our Anti-Spam & Abuse Policy. Such enforcement may include temporary or permanent suspension of outbound email ports, IP isolation, or null-routing to protect network reputation. Repeated or unaddressed spam-related violations may result in complete service termination without refund and permanent loss of the assigned IP range. Blacklist removal or remediation requests may incur additional non-refundable administrative or third-party costs as specified in the Anti-Spam & Abuse Policy (Sections 8–10).

    6. EXCESSIVE USE OF RESOURCES OR NETWORK ABUSE

    You may not consume excessive amounts of server, CPU, memory, disk I/O, or network bandwidth, or otherwise use SCALIBIT Services in a manner that causes degradation of performance, denial of service, instability, or disruption to other customers or to SCALIBIT’s infrastructure and verified data center partner environments. SCALIBIT Services are shared in nature unless otherwise specified (e.g., Dedicated Servers), and fair usage applies to ensure quality of service across all users.

    Examples of excessive or abusive use include, without limitation:

    • Hosting, linking to, or operating any anonymous, open, or high-load proxy server.

    • Running persistent daemons, background processes, bots, or scripts that generate continuous CPU, RAM, or disk I/O load.

    • Operating public file sharing, mirror, streaming, or mass download services that disproportionately consume network capacity.

    • Running mining, crawling, or scraping operations that continuously occupy server resources or network throughput.

    • Maintaining non-essential persistent network connections (e.g., via idle bots, keep-alive loops, or socket floods).

    • Utilizing software that interfaces with Internet Relay Chat (IRC) or similar command/control networks that may cause abuse or load instability.

    • Executing large-scale or scheduled cron jobs that heavily consume system resources or negatively impact disk and CPU performance.

    • Performing benchmark, stress, or load testing on SCALIBIT’s infrastructure or network without prior written authorization.

    All SCALIBIT services are monitored for stability and performance. Excessive or disproportionate usage that affects service availability or violates fair use thresholds may result in throttling, suspension, or permanent termination at SCALIBIT’s discretion. Customers are encouraged to upgrade to a higher-tier plan or Dedicated Server if their resource requirements exceed standard operational levels.

    Network Stability & Abuse Prevention.

    Network usage must remain within normal operational parameters. Activities such as bandwidth saturation, SYN floods, excessive API polling, ICMP floods, or other forms of packet abuse are strictly prohibited. Customers must not perform port scanning, packet sniffing, or intrusion attempts on any SCALIBIT or third-party network.

    Use of network tunneling, packet relay, or protocol manipulation tools that disguise or reroute traffic for abusive or unauthorized purposes is strictly forbidden. Running public VPN endpoints, Tor nodes, or anonymization gateways on shared or cloud instances is considered a violation of this policy.

    Customers are responsible for maintaining valid DNS and reverse DNS (rDNS) configurations, accurate WHOIS data, and proper email authentication (SPF, DKIM, DMARC). Failure to maintain such configurations may result in degraded mail delivery, IP reputation issues, or suspension. Any customer action that results in SCALIBIT IP addresses or domains being listed on public abuse databases (e.g., Spamhaus, Barracuda, Proofpoint, UCEPROTECT, or RIPE NCC Abuse) may incur administrative or remediation fees as described under Section 30 of the Terms of Service.

    Monitoring and Enforcement.

    SCALIBIT continuously monitors system performance, network utilization, and abuse patterns across its infrastructure and verified data center partner environments. Where resource consumption or activity is determined to be abusive or detrimental to service stability, SCALIBIT may take immediate corrective measures — including but not limited to process termination, traffic filtering, bandwidth throttling, temporary suspension, or permanent account termination. Such enforcement actions may occur without prior notice when necessary to maintain operational integrity or protect the security of SCALIBIT’s infrastructure and customers.

    Customers will generally be notified via registered email or through the Client Area when resource thresholds are exceeded or enforcement actions are taken. Repeated, willful, or severe violations may result in permanent account closure and revocation of related IP allocations without refund.

    Security & Legal Cooperation.

    Any excessive or abusive activity that results in network degradation, distributed denial-of-service (DDoS), or unauthorized interference with other systems may be reported to relevant law enforcement or regulatory authorities. SCALIBIT reserves the right to preserve system logs, restrict traffic, or isolate affected services during mitigation — in coordination with its verified data center partners when technically required.

    Customers are responsible for maintaining adequate security configurations — including firewall rules, resource limits, and abuse-prevention measures — to prevent their systems from participating in attacks or causing service instability. Failure to secure a system that repeatedly participates in abuse or consumes excessive shared resources may result in immediate suspension or termination without refund.

    SCALIBIT reserves the sole right to determine what constitutes excessive usage or network abuse. Decisions made under this section are final and not subject to dispute or reversal.

    In the event of network abuse, fraud, or cybercrime originating from a Customer’s Service, SCALIBIT may immediately suspend or disable the affected Service and cooperate with competent local and international law enforcement authorities under applicable regulations to mitigate and investigate the incident. Such cooperation shall be limited to the minimum scope required by law and will always comply with relevant data protection and privacy frameworks.

    For additional prohibitions relating to unauthorized access, DDoS activity, open proxy operation, or other network-level violations, see AUP §15 (No Network Abuse).

    7. RESOURCE USAGE AND CUSTOMER RESPONSIBILITIES

    Shared system resources such as Central Processing Unit (CPU), memory (RAM), disk I/O, and network bandwidth must not be abused or monopolized. High or continuous usage that causes performance degradation, instability, or interference with other customers or SCALIBIT systems may result in immediate suspension or limitation of your Services.

    You acknowledge and agree that you and your end users will not excessively consume available server resources, run persistent background processes, or engage in activities that generate unreasonable load. SCALIBIT reserves the right, at its sole discretion, to suspend, throttle, or terminate any account or process without prior warning if such usage is deemed excessive or detrimental to overall system performance.

    7.1 Shared Hosting Purpose & Limitations.

    Unless explicitly stated otherwise, Shared Web Hosting (cPanel Hosting, CWPpro Hosting, WordPress Hosting) services are intended solely for website and email operation. Activities such as batch processing, continuous data archiving, cryptocurrency mining, web crawling, automated backups, video transcoding, or content mirroring are strictly prohibited. Pornographic, adult streaming, gambling, or lottery-related content is not permitted. SCALIBIT reserves the right to take immediate corrective action, including account suspension or termination, to maintain system stability and compliance.

    For Shared Hosting and WordPress Hosting accounts, scheduled tasks (cron jobs) must not be configured to run at intervals shorter than fifteen (15) minutes. Excessive or continuously running cron jobs that cause high CPU, I/O, or memory usage may result in automatic suspension or limitation. For Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute Services (Standard Performance, High Performance, High Frequency), Optimized Cloud Compute Services (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), and Dedicated Servers (Dedicated Servers or Bare Metal), cron job usage is permitted but must not negatively impact system performance, stability, or network operations. SCALIBIT reserves the right to disable or limit any scheduled tasks that violate these conditions.

    7.2 Customer-Managed Environments.

    For services such as Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute Services (Standard Performance, High Performance, High Frequency), Optimized Cloud Compute Services (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), and Dedicated Servers (Dedicated Servers or Bare Metal), SCALIBIT acts solely as an infrastructure provider. Customers retain full administrative and technical control over their systems, configurations, and hosted data. SCALIBIT does not access, monitor, or manage customer data, configurations, or software unless explicitly requested by the Customer within a verified support session or when required by a valid legal process.

    Customers are solely responsible for maintaining system updates, applying security patches, performing regular backups, and ensuring proper access control. SCALIBIT shall not be held liable for data loss, corruption, unauthorized access, or any damage resulting from customer misconfiguration, negligence, or software vulnerabilities.

    In cases where technical assistance requires temporary administrative access, SCALIBIT may, at its discretion, provide limited support under controlled conditions. Such access must be explicitly granted by the customer and revoked or changed immediately upon resolution of the support request.

    7.3 Backups Responsibility.

    Backup services are provided only as a courtesy for Shared Web Hosting (cPanel Hosting, CWPpro Hosting, WordPress Hosting) accounts. These backups are performed weekly and are not guaranteed for completeness, accuracy, or availability. All other infrastructure-based services — including Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute Services (Standard Performance, High Performance, High Frequency), Optimized Cloud Compute Services (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), and Dedicated Servers (Dedicated Servers or Bare Metal) — are fully customer-managed and excluded from automated backup coverage. Customers are solely responsible for maintaining their own independent backups outside SCALIBIT’s network.

    Hardware Failures and Data Loss. SCALIBIT shall not be held responsible or liable for any data loss, corruption, or unavailability resulting from hardware or system failures — including but not limited to hard drive malfunction, RAID controller failure, power supply defects, or other component damage. While SCALIBIT employs enterprise-grade hardware and redundancy measures, no hardware or storage medium is immune to failure. Customers are solely responsible for maintaining their own off-site or independent backups to prevent data loss.

    7.4 System-Level Security and IP Hygiene.

    Customers must maintain valid DNS and reverse DNS (rDNS) configurations, accurate WHOIS data, and proper email authentication records (SPF, DKIM, DMARC). Failure to maintain proper configurations or to remediate abuse-related IP listings (e.g., Spamhaus, Barracuda, Proofpoint) may lead to suspension or additional remediation charges as outlined in the Terms of Service (Section 30).

    7.5 Unauthorized Infrastructure Use.

    Operating file repositories, high-volume data storage, CDN services, or running benchmark, stress, or load testing on SCALIBIT infrastructure without express written consent is strictly prohibited. Such activity is considered excessive resource utilization and may result in immediate suspension or permanent termination.

    You may use SCALIBIT Services and the IP addresses assigned to you solely for lawful and authorized purposes. Any unlawful, abusive, or fraudulent activity originating from customer-managed environments is the sole responsibility of the customer. SCALIBIT reserves the right to cooperate fully with competent authorities and data center operators in case of investigations or abuse reports.

    Failure to maintain secure configurations, apply software updates, or prevent recurring abuse from your servers may result in suspension, throttling, or permanent termination without refund.

    8. UNAUTHORIZED SYSTEM ACCESS

    You may not directly or indirectly use the Services to gain unauthorized access to any network, system, or data, or attempt to interfere with the integrity or security of any SCALIBIT or third-party system. This restriction applies to all SCALIBIT Services, including but not limited to Shared Web Hosting, Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute Services (Standard Performance, High Performance, High Frequency), Optimized Cloud Compute Services (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), and Dedicated Servers or Bare Metal environments.

    Prohibited actions include, without limitation:

    • Accessing or attempting to access another network or system without authorization, including probing, port scanning, fingerprinting, vulnerability testing, or breaching authentication or security measures;

    • Launching or participating in attacks against other networks or systems (including but not limited to Denial of Service (DoS), Distributed Denial of Service (DDoS), brute-force, packet flooding, or resource exhaustion attacks);

    • Intercepting, monitoring, capturing, or tampering with data, traffic, or communications without consent;

    • Spoofing, forging, or misrepresenting identity or network information (including IP, MAC address, or packet header data) to disguise origin or bypass security restrictions;

    • Using any automated or unauthorized method, including deep-linking, scraping, crawling, indexing, data mining, offline readers, macros, bots, brute-force tools, or similar technologies, to access, collect, or manipulate SCALIBIT’s websites, APIs, systems, or Client Area without explicit written authorization;

    • Attempting to exploit or interfere with any SCALIBIT security mechanisms, monitoring tools, or abuse detection systems;

    • Deploying malware, viruses, worms, trojans, keyloggers, rootkits, backdoors, or any software intended to damage, disrupt, or gain unauthorized control of systems or data.

    Any attempt to gain unauthorized access, disrupt stability, or compromise the security or performance of SCALIBIT’s or any third-party network will result in immediate suspension and may be reported to law enforcement authorities, in accordance with applicable laws and regulations.

    Customers are responsible for maintaining secure configurations, regularly applying security updates, and ensuring that their systems, applications, and credentials are not used to perform or facilitate any unauthorized access attempts. Failure to maintain appropriate security practices or to prevent such activity may result in immediate suspension, termination, or permanent account closure without refund.

    If SCALIBIT identifies that your Service or account is involved in unauthorized access attempts, intrusion testing, or any other activity that threatens network integrity, SCALIBIT reserves the right to immediately disable affected systems, restrict network access, or isolate the service to protect the infrastructure and other customers. Restoration may require a security audit, administrative review, or a non-refundable reactivation fee.

    You must not use SCALIBIT’s Services or IP addresses for the purpose of bypassing, masking, or anonymizing the origin of attacks, network traffic, or identity. The operation or promotion of proxy, VPN, or anonymization services that facilitate or conceal unauthorized access is strictly prohibited.

    Violations of this section may also be subject to enforcement actions, penalties, or liquidated damages under Section 30 (Abuse, Spam & Enforcement) of the Terms of Service. These provisions align with Section 15 (Additional Rules for Cloud Services and Dedicated Servers), which strictly prohibits hacking, spoofing, unauthorized intrusion, and network exploitation. Customers are also bound by the obligations outlined in Section 16 (Customer-Managed Servers and Responsibilities) to maintain proper security measures and prevent misuse.

    SCALIBIT reserves the right to modify, restrict, or suspend network access to ensure compliance with operational, legal, or security requirements, as authorized under Section 36 (Changes to SCALIBIT’s Network) of the Terms of Service. Customers are required to cooperate fully with any investigation, abuse report, or incident inquiry, consistent with Section 30.3 (Incident Notification & Cooperation).

    9. STORAGE OF BACKUPS

    Using a shared account as a backup or storage device. You may not use your Shared Web Hosting (cPanel Hosting, CWPpro Hosting, WordPress Hosting) account as a backup solution, file archive, or data storage repository. These services are designed exclusively for hosting active website content and related functionality. Storing excessive files, media archives, or backup copies unrelated to the primary website is strictly prohibited and may result in removal without notice.

    Email storage and archiving. Shared Web Hosting email accounts are intended for active use only. Long-term or large-scale email archiving, such as storing years of inactive or outdated emails to use the service as an archive, is not permitted. Customers must download or migrate such data to local or external storage. SCALIBIT reserves the right to remove or restrict excessive mailbox storage that impacts system performance, inode usage, or backup operations.

    Inode limits and excessive file storage. Each Shared Hosting account is subject to an inode (file count) limit to maintain optimal system stability and backup reliability. Excessive storage of emails, temporary files, cache data, or backups may cause an account to reach its inode limit. Once the inode limit is reached, no new files can be created — this includes incoming emails, FTP uploads, and website-generated files (such as images, cache, or temporary files). As a result, email delivery, file uploads, and normal website operations may be disrupted until the inode usage is reduced. Customers are responsible for maintaining their file usage within the defined inode limits.

    SCALIBIT reserves the right to remove such files, backups, or excessive email archives from your hosting account at any time, with or without prior notice. Backup or storage usage outside intended web hosting purposes constitutes a violation of this policy and may result in account suspension or termination.

    Backup services are provided only as a courtesy for Shared Web Hosting and WordPress Hosting accounts and may be modified or terminated at any time at SCALIBIT's discretion. SCALIBIT’s backup system typically runs once per week and may overwrite previous backups. There is no guarantee of success, completeness, or restoration availability.

    Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute Services (Standard Performance, High Performance, High Frequency), Optimized Cloud Compute Services (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), and Dedicated Servers (Dedicated Servers or Bare Metal) do not include backup services. Customers must independently back up and protect their own data. SCALIBIT is not liable for any data loss, corruption, or unavailability. Customers are strongly advised to store backups on external/off-site systems.

    Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute Services (Standard Performance, High Performance, High Frequency), Optimized Cloud Compute Services (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), and Dedicated Servers (Dedicated Servers or Bare Metal) where customers are fully responsible for their own backup configurations, email storage, and data management. However, SCALIBIT reserves the right to intervene if storage usage negatively impacts network performance or system stability.

    For Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute Services (Standard Performance, High Performance, High Frequency), Optimized Cloud Compute Services (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), and Dedicated Servers (Dedicated Servers or Bare Metal) services, no customer data is retained after termination. Upon service termination, cancellation, or re-provisioning, all data (including data on attached volumes, snapshots, and temporary storage) is permanently and irreversibly deleted and cannot be recovered. Customers are solely responsible for maintaining external or off-site backups prior to service termination.

    This section aligns with Sections 13 (Hosting), 25 (Backups and Data Loss), and 34 (Termination & Cancellation Policy) of the Terms of Service.

    10. MINING OF CRYPTOCURRENCIES

    The mining of any cryptocurrency is strictly prohibited across all SCALIBIT platforms and infrastructure, including but not limited to: Shared Web Hosting (cPanel Hosting, CWPpro Hosting, WordPress Hosting), Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute Services (Standard Performance, High Performance, High Frequency), Optimized Cloud Compute Services (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), and Dedicated Servers (Dedicated Servers or Bare Metal) services,

    This prohibition applies to all forms of mining, whether individual, collective, or cloud-based, as well as the operation of mining pools, hash-rate resale, or any software, process, or service designed to utilize CPU, GPU, or storage resources for cryptocurrency mining or blockchain validation purposes.

    Any account found engaging in or facilitating mining activity will be subject to immediate suspension or termination without prior notice. SCALIBIT reserves the right to take additional actions, including reporting such activities to competent authorities, upstream providers, or financial intelligence units (FIUs) if necessary.

    11. INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS

    You may not use the Services to infringe upon another party’s intellectual property rights. This includes, but is not limited to, the unauthorized copying, distribution, or public display of movies, music, books, photographs, software (including warez), or any other copyrighted material.

    Selling, distributing, or offering to sell counterfeit or pirated merchandise is strictly prohibited and will result in the immediate suspension or termination of your account. Any account found to be infringing upon the intellectual property rights of others will be subject to expeditious removal of infringing material or access restrictions. Repeated or willful violations will result in permanent suspension or account termination.

    SCALIBIT respects the copyrights, trademarks, and other intellectual property rights of others and expects its users to do the same. As a service provider, SCALIBIT complies with the Digital Millennium Copyright Act (DMCA) and processes valid notices of alleged infringement accordingly.

    To the extent SCALIBIT receives a proper notice of infringement of copyright, trademark, or other intellectual property, SCALIBIT reserves the right to access, preserve, and disclose to third parties any information or data (including personally identifiable information and private communications) related to a written complaint of infringement, if SCALIBIT believes in its sole discretion that such access, preservation, or disclosure is necessary or appropriate to respond to or address such complaint.

    SCALIBIT expressly reserves the right to terminate, in appropriate circumstances, the account or access rights of any subscriber found to be a repeat infringer. SCALIBIT also reserves the right to terminate an account or subscriber for a single confirmed instance of infringement.

    Proper notice of infringement shall include the following information, provided in writing to SCALIBIT’s designated DMCA agent:

    • The electronic or physical signature of the rights holder or the person authorized to act on behalf of the rights holder;

    • Identification of the copyrighted or trademarked work claimed to have been infringed;

    • Identification of the material that is claimed to be infringing or the subject of infringing activity, and information reasonably sufficient to permit SCALIBIT to locate the material (such as a URL);

    • Your name, address, telephone number, and email address;

    • A statement by you that you have a good faith belief that the disputed use is not authorized by the rights holder, its agent, or the law; and

    • A statement that the information in your notification is accurate and, under penalty of perjury, that you are the rights holder or authorized to act on the rights holder’s behalf.

    SCALIBIT responds only to valid DMCA-compliant notices. Complaints that fail to meet these requirements will not be processed. You are required to comply with the DMCA when using SCALIBIT’s Services and when submitting infringement complaints.

    SCALIBIT reserves the right to forward valid complaints to the affected customer for response or remediation.

    Weekly courtesy backups are performed for Shared Web Hosting (cPanel Hosting, CWPpro Hosting, WordPress Hosting) accounts. These backups are NOT guaranteed and are taken at SCALIBIT’s sole discretion. SCALIBIT reserves the right to modify, discontinue, or remove this backup service at any time without prior notice. Customers are fully responsible for maintaining their own independent backups, and SCALIBIT shall not be held liable for any data loss under any circumstance.

    Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute Services (Standard Performance, High Performance, High Frequency), Optimized Cloud Compute Services (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), and Dedicated Servers (Dedicated Servers or Bare Metal) do not include backup services. Customers must independently back up and protect their own data. SCALIBIT is not liable for any data loss, corruption, or unavailability.     IT IS SOLELY THE CUSTOMER'S DUTY AND RESPONSIBILITY TO BACK UP THEIR FILES AND DATA HOSTED ON SCALIBIT SERVERS. UNDER NO CIRCUMSTANCES WILL SCALIBIT BE LIABLE TO ANYONE FOR DAMAGES OF ANY KIND UNDER ANY LEGAL THEORY FOR LOSS OF CUSTOMER FILES AND/OR DATA.

    SCALIBIT reserves the right to charge a restoration fee if a customer requests recovery from an available backup. Additionally, SCALIBIT will not attempt to back up accounts exceeding 100,000 inodes (files) or 20 GB of storage. Backup exclusions apply to all unmanaged and compute services.

    13.1 Shared Web Hosting

    Backup services are provided only as a courtesy for Shared Web Hosting (cPanel Hosting, CWPpro Hosting, WordPress Hosting) accounts and may be modified or terminated at any time at SCALIBIT's discretion. SCALIBIT’s backup system typically runs once per week and may overwrite previous backups. There is no guarantee of success, completeness, or restoration availability.

    Accounts reaching their inode limit or excessive storage usage may experience service degradation, including the inability to receive new emails, upload files via FTP, or add website content. Customers are responsible for managing storage usage and maintaining their own backups.

    For canceled or terminated Shared Web Hosting accounts (including non-payment), SCALIBIT may, at its discretion, retain an available backup for up to three (3) months. After that period, all backups are automatically and permanently deleted. Backup retention and restoration are not guaranteed and may incur additional fees.

    If a customer requests restoration of data after service cancellation or non-payment, the service must first be renewed and reactivated by paying the renewal fee. Only after reactivation can SCALIBIT process a restore request, which is subject to a separate restoration fee. The standard restoration fee is 25 USD per 0–5 GB of data (e.g., 0–5 GB = 25 USD, 5–10 GB = 50 USD, and so on). Restoration is possible only if a valid, usable backup exists, and availability is not guaranteed.

    13.2 Virtual Machines, Cloud Services, Cloud Compute, Optimized Cloud Compute, and Dedicated Servers or Bare Metal

    These services do not include any backup solution provided by SCALIBIT. Upon termination, cancellation, or re-provisioning, all data is permanently deleted and cannot be recovered. It is the customer’s sole responsibility to maintain independent, off-site backups at all times.

    References to any future “Cloud Backup” or “Site Backup & Restore” add-ons are anticipatory and, if offered, will be provided on a best-effort, no-warranty basis. Such add-ons do not alter the customer’s obligation to maintain their own off-site backups.

    13.3 Retention Policy

    SCALIBIT retains customer data only for as long as necessary to deliver the Services or as required by applicable law. Once a hosting account or service is terminated, suspended, or canceled, all associated data (including files, databases, emails, and configurations) may be permanently deleted after the applicable retention period, in accordance with applicable data protection and privacy laws.

    For Shared Web Hosting (cPanel Hosting, CWPpro Hosting, WordPress Hosting), available backups (if any) may be retained for up to three (3) months following termination or cancellation. After this period, all data and backups are automatically and irreversibly deleted from SCALIBIT systems in compliance with applicable data protection and privacy regulations.

    For Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute Services (Standard Performance, High Performance, High Frequency), Optimized Cloud Compute Services (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), and Dedicated Servers (Dedicated Servers or Bare Metal), no data is retained after termination. Upon account deletion, cancellation, or re-provisioning, all stored data is permanently destroyed and cannot be recovered. Customers are solely responsible for maintaining external or off-site backups prior to service termination.

    This retention and deletion policy applies uniformly to all SCALIBIT services and infrastructure, regardless of geographic region or datacenter location, and is implemented in full compliance with applicable data protection, privacy, and information security laws, including but not limited to GDPR, CCPA, and KVKK where applicable.

    SCALIBIT does not provide any guarantee regarding the availability, completeness, or accuracy of retained data or backups. It is the customer’s sole responsibility to maintain independent, off-site copies of all important data.

    14. NO SECURITY VIOLATIONS

    You may not use the Services to violate the security or integrity of any network, computer, or communications system, software application, or network or computing device (each, a “System”). Such actions threaten both SCALIBIT’s infrastructure and other Internet users.

    Prohibited activities include, but are not limited to:

    • 14.1 Harmful Software. Uploading, distributing, or executing content, software, or any technology designed to damage, interfere with, intercept, or expropriate any computer system, program, or data. This includes but is not limited to viruses, malware, spyware, adware, Trojan horses, worms, logic bombs, or similar malicious code.

    • 14.2 Unauthorized Access. Accessing or attempting to access any System, account, or data without permission. This includes probing, scanning, or testing the vulnerability of a System, or breaching any security or authentication measures used by a System.

    • 14.3 Interception. Monitoring, capturing, or intercepting data, traffic, or communications on any System without authorization.

    • 14.4 Falsification of Origin. Using false, forged, or misleading TCP/IP packet headers, email headers, or any part of a message describing its origin or routing path. This prohibition does not apply to the legitimate use of aliases or privacy-enhancing remailers, provided they are used for lawful and non-abusive purposes.

    Any attempt to compromise or disrupt the stability, confidentiality, or availability of SCALIBIT systems or other networks may result in immediate suspension or termination of Services and may be reported to law enforcement authorities as required by applicable local, state, and federal laws of the United States, as well as all applicable foreign, national, and international laws and regulations, including the laws of the countries where SCALIBIT’s servers, data centers, and infrastructure are physically located.

    15. NO NETWORK ABUSE

    You may not use the Services to make unauthorized network connections to any users, hosts, or networks, or engage in any activity that interferes with the normal operation of SCALIBIT or any third-party network. Prohibited activities include, but are not limited to:

    • 15.1 Monitoring or Crawling. Performing monitoring, crawling, or data harvesting of a System in a manner that impairs, disrupts, or overloads the System being accessed. This includes scraping or automated extraction of data from any part of the Services without authorization.

    • 15.2 Deceitful Actions. Introducing intentionally, knowingly, or recklessly, any malicious or contaminating code into the Services; or collecting, transmitting, or using information (including email addresses, usernames, or other identifiers) through deceptive or covert means, such as phishing, social engineering, Internet scams, password harvesting, or automated spidering.

    • 15.3 Intentional Interference. Interfering with or disrupting the normal functioning of any System, including deliberate overloading through mail bombing, news bombing, broadcast attacks, flooding techniques, or conducting a Denial of Service (DoS) or Distributed Denial of Service (DDoS) attack.

    • 15.4 Operation of Certain Network Services. Operating open proxies, open mail relays, open recursive domain name servers, Tor exit nodes, or other similar unrestricted network services that may be abused by third parties.

    • 15.5 Avoiding System Restrictions. Using manual or automated means to circumvent usage limitations, rate limits, access restrictions, or storage quotas imposed on a System.

    • 15.6 Retaliation Against SCALIBIT. Engaging in any activity intended to cause harm or retaliation against SCALIBIT, its Services, employees, or systems, including behavior that results in any SCALIBIT server becoming the target of a DoS or similar attack.

    • 15.7 Withholding Identity. Concealing or falsifying identity or contact information, including the omission, deletion, forgery, or misrepresentation of transmission details or identification data such as IP addresses, return email headers, or WHOIS contact information.

    • 15.8 Excessive Use. Excessive consumption of CPU, bandwidth, or disk I/O that adversely impacts other customers or network stability is prohibited. Such cases are governed under AUP §6 (Excessive Use of Resources or Network Abuse), and may result in throttling, suspension, or termination of the affected Services.

    • 15.9 Mining of Cryptocurrencies. Performing or facilitating any form of cryptocurrency mining, including but not limited to Bitcoin, Ethereum, or other blockchain-based operations, without SCALIBIT’s explicit written authorization.

    • 15.10 Illegal or Fraudulent Activity. Using SCALIBIT Services, servers, or IP addresses to facilitate, conceal, or otherwise enable illegal or fraudulent activity — including but not limited to identity theft, payment fraud (for example, use of stolen or cloned credit cards), operating illegal marketplaces, or processing proceeds of unlawful activity — is strictly prohibited.

    • 15.11 Anonymization for Unlawful Use. Provisioning, operating, or offering VPNs, proxies, or anonymization services that conceal identity for illegal purposes, or that facilitate criminal, fraudulent, or abusive behavior, is also strictly prohibited. SCALIBIT reserves the right to suspend or terminate such Services immediately and report the activity to competent authorities when required by law.

    Any activity in violation of this section may result in immediate suspension or termination of Services without notice. SCALIBIT reserves the right to cooperate fully with law enforcement authorities or third-party abuse teams to investigate and mitigate network abuse incidents.

    16. VULNERABILITY TESTING

    You may not attempt to probe, scan, penetrate, or test the vulnerability of any SCALIBIT system, network, or Service, nor attempt to breach any security or authentication measures, whether by passive or intrusive techniques, without SCALIBIT’s prior written authorization.

    This includes, but is not limited to, performing security assessments, penetration testing, load or stress testing, or malware analysis on or through SCALIBIT’s infrastructure, IP addresses, or domains. Unauthorized testing or scanning is strictly prohibited and may result in immediate suspension of Services and reporting to law enforcement authorities.

    17. SERVER ABUSE

    Any attempts to undermine, disrupt, or cause harm to any SCALIBIT server, service, network, or customer are strictly prohibited. SCALIBIT holds no responsibility for actions performed using clients’ accounts. Any account that abuses system resources, performs malicious activities, or fails to cease resource misuse after notification may be immediately suspended or terminated without refund.

    Any website, script, or service consuming excessive CPU cycles, memory, or other resources that degrade server performance may be subject to throttling, suspension, or the offer of modified terms. Use of our Services to access or attempt to access accounts of others, or to penetrate, or attempt to penetrate, the security measures of SCALIBIT or any third-party systems, software, or communications infrastructure, is strictly prohibited.

    You must not use the Services to transmit, host, or engage in any illegal, harmful, fraudulent, or offensive activity. You are responsible for ensuring full compliance with all applicable laws in both your jurisdiction and the jurisdiction of the server location.

    You may use SCALIBIT Services solely for lawful purposes. Any unlawful use is strictly prohibited. You are fully responsible for all activities carried out through your Services and assigned IP addresses. In the event of any criminal investigation or legal process, SCALIBIT reserves the right to cooperate fully with law enforcement and competent authorities as required by applicable law.

    Attempting to access, probe, scan, or compromise any SCALIBIT system, service, or other customer account without authorization is strictly prohibited. This includes port scanning, brute-force attacks, packet sniffing, unauthorized monitoring, or exploiting vulnerabilities in SCALIBIT or third-party systems.

    The use of SCALIBIT’s Services, servers, or any assigned IP addresses to conceal, mask, or falsify identity or origin — including operating VPNs, proxies, Tor exit nodes, or anonymization services for illegal or abusive purposes — is strictly prohibited.

    Hosting, transmitting, or distributing illegal content — including but not limited to child sexual abuse material (CSAM), terrorism-related material, hate speech, or any form of fraud, phishing, or financial crime — will result in immediate service termination and may be reported to law enforcement authorities.

    Hosting, operating, or distributing malware, ransomware, botnets, keyloggers, or any software designed to harm or exploit others is strictly prohibited. SCALIBIT may suspend or terminate services involved in such activity without prior notice.

    You must comply with all applicable export control laws and international sanctions. Use of SCALIBIT infrastructure to engage with or provide services to sanctioned entities, individuals, or countries (including OFAC-restricted regions) is strictly forbidden.

    For detailed legal definitions of prohibited activities and enforcement procedures, please refer to our Terms of Service, Sections 15 and 17.

    18. BLACKLISTING

    You agree that if any SCALIBIT-assigned IP address, subnet, or range associated with your Services becomes listed on any third-party abuse database, email reputation list, or blacklist (including but not limited to Spamhaus, Barracuda, SpamCop, or UCEPROTECT), it constitutes a violation of this Acceptable Use Policy (AUP).

    Customers are solely responsible for all activities originating from their assigned IP addresses and must ensure that their usage does not cause degradation of IP reputation, blocklisting, or abuse listings that may affect other network users.

    SCALIBIT reserves the right to take immediate and reasonable action to protect its network reputation and IP resources, including but not limited to temporary suspension, replacement of IP addresses, additional fees for IP delisting, or any related third-party remediation or enforcement costs, or permanent termination of the affected Services.

    Blacklisting or blocklisting may occur when a customer’s IP, domain, or server is flagged for abusive behavior, spam, malware, or policy violations. Such listings may occur regardless of whether the activity originated directly from the customer or from third-party users of the customer’s systems. SCALIBIT is not responsible for third-party blocklist decisions.

    You acknowledge and agree that such listings may occur regardless of whether the blacklisting was caused directly or indirectly by your actions, the actions of your users, or third-party software installed under your control. Maintaining clean and reputable use of assigned IP addresses is solely your responsibility.

    If your account or IP reputation negatively impacts mail deliverability for other customers, SCALIBIT may immediately suspend outgoing mail delivery or restrict port access until the issue is resolved. Customers are required to cooperate fully in delisting efforts, and any delisting or remediation costs shall be borne by the customer.

    In the event of repeated blacklisting, failure to cooperate with delisting procedures, or continued abuse, SCALIBIT may terminate the affected Services without refund. All IP address allocations remain the property of SCALIBIT and may be reclaimed at any time if misuse or abuse is detected.

    This policy applies to all IP addresses assigned under any SCALIBIT service category, including Shared Web Hosting, Virtual Machines, Cloud Services, Cloud Compute, Optimized Cloud Compute, and Dedicated Servers / Bare Metal.

    19. OUR MONITORING AND ENFORCEMENT

    We reserve the right, but do not assume the obligation, to monitor, investigate, or enforce compliance with this AUP and to address any violation of this AUP or misuse of the Services.

    • Investigate violations of this AUP or misuse of the Services;

    • Review, audit, or monitor any User Content or activity associated with your account, and remove, disable access to, or modify any content or resource (including User Content) that violates this AUP or any other agreement we have with you for use of the Services;

    • Monitor all prohibited actions, investigate, and/or take appropriate enforcement action at our sole discretion, including suspension, throttling, or termination of affected Services.

    If you violate this AUP or any other provision of the Terms of Service, or otherwise create liability for us or any other person, including reputational harm, we may (without limitation) and in addition to the above, terminate or suspend your Account and/or your access to any or all Services, with or without notice. We may also take legal action to enforce our rights, and/or report you to appropriate law enforcement authorities, regulators, or other appropriate third parties.

    PLEASE BE AWARE THAT WE COOPERATE WITH LAW ENFORCEMENT AND REPORT SUSPICIOUS AND/OR ILLEGAL ACTIVITY.

    Our reporting may include disclosing appropriate customer information, logs, metadata, or account activity. We may cooperate with competent authorities, regulators, or third-party investigators to assist in identifying, investigating, and prosecuting illegal conduct, as permitted or required by law.

    SCALIBIT reserves the right to preserve, archive, or retain any logs, metadata, or other digital evidence for internal investigation, security auditing, regulatory compliance, or legal proceedings, in accordance with applicable laws and regulations.

    In accordance with our Privacy Notice, we may share and/or use your information to protect the safety, rights, property, or security of SCALIBIT, our Services, customers, or the public; to detect, prevent, or address fraud, abuse, cybersecurity, or technical issues; to prevent or stop any activity that SCALIBIT, in its sole discretion, may consider to be illegal, unethical, or harmful; to use as evidence in litigation; to conduct audits; and/or to enforce this Acceptable Use Policy and our Terms of Service.

    SCALIBIT does not control or endorse the content, messages, or information transmitted through the Services and specifically disclaims any liability regarding user-generated content or actions resulting from participation in any Service. SCALIBIT shall have no obligation to maintain any content, data, or backups after termination or expiration of the Services.

    You may use SCALIBIT Services solely for lawful purposes. Any unlawful use is strictly prohibited. You are fully responsible for all activities carried out through your Services and assigned IP addresses. In the event of any criminal investigation or legal process, SCALIBIT reserves the right to cooperate fully with law enforcement and competent authorities as required by applicable law.

    You agree to indemnify and hold SCALIBIT, its affiliates, officers, and employees harmless from any and all claims, damages, losses, liabilities, or costs (including legal fees and any third-party claims) arising from or related to your violation of this AUP, the Terms of Service, or misuse of the Services.

    20. SECURITY

    You are solely responsible for maintaining the security, confidentiality, and integrity of your server, website, and hosting account. You are also responsible for any misuse, abuse, or unauthorized activity occurring under your account, whether performed by you, your employees, contractors, friends, family, guests, or any third party (including but not limited to malicious users, attackers, or hackers).

    You must take all reasonable steps to prevent unauthorized access to your Services, including but not limited to using strong passwords, enabling two-factor authentication where available, maintaining up-to-date software, and restricting administrative access. Sharing your login credentials or account access with unauthorized users is strictly prohibited. You are fully responsible for all actions taken using your credentials, even if you did not authorize such use.

    You may not use your account or any SCALIBIT system to breach or attempt to breach the security of another account, system, or network, nor may you attempt to gain unauthorized access to any data, system, or resource. Attempting to obtain another user's password, circumvent authentication mechanisms, or exploit vulnerabilities is strictly prohibited and may result in immediate suspension or termination of your Services, without refund.

    This AUP also prohibits any actions that compromise the integrity or security of SCALIBIT’s systems, networks, customers, or the broader Internet. SCALIBIT reserves the right to immediately suspend or terminate your account, without notice, as a result of such activities by you or your end users. You may also be exposed to civil and criminal liability based on your actions.

    Examples of prohibited activities include, but are not limited to: unauthorized access, probing, scanning, or testing of any system or network; interference with service to any user, host, or network (including mail bombing, flooding, deliberate attempts to overload a system, or broadcast attacks); or forging of any TCP/IP packet header or any part of the header information in an email or network transmission.

    You are responsible for ensuring that all customer-provided software, plugins, and scripts installed on your server are regularly updated and patched following industry best practices. SCALIBIT makes no warranty, express or implied, for the security, functionality, or operability of third-party software, code, or scripts installed on your Services.

    You acknowledge that the Internet is an inherently insecure environment, and you are solely responsible for safeguarding your data, credentials, and confidential information. SCALIBIT is not responsible for unauthorized access resulting from your failure to implement appropriate security measures.

    You may use SCALIBIT Services solely for lawful purposes. Any unlawful or unauthorized use is strictly prohibited. SCALIBIT reserves the right to fully cooperate with law enforcement and competent authorities in the investigation of any criminal, fraudulent, or abusive activity.

    21. CHILD SEXUAL ABUSE MATERIAL (CSAM), CHILD PORNOGRAPHY, CHILD EROTICA, AND BESTIALITY

    SCALIBIT enforces a zero-tolerance policy toward any material or activity that constitutes, depicts, promotes, or facilitates child sexual abuse material (CSAM), child pornography, child erotica, sexual exploitation of minors, grooming, or bestiality (zoophilia). This prohibition applies to all formats and media, including but not limited to images, videos, audio recordings, written descriptions, drawings, computer-generated, AI-generated, or deepfake/simulated content.

    Use of the Services to create, store, host, distribute, advertise, promote, link to, or otherwise make available any such material is strictly prohibited. SCALIBIT may, without notice, immediately remove or disable access to the content, suspend or terminate related Services, and permanently close the associated accounts. All related evidence may be preserved and reported to competent law-enforcement authorities, including the National Center for Missing & Exploited Children (NCMEC), the CyberTipline, and other agencies as required by applicable law.

    Additionally, SCALIBIT reserves the right to report suspicious or borderline material involving minors to competent authorities for further investigation — even where the material may not meet the narrow legal definition of child pornography or CSAM. Such discretion is exercised to ensure the protection of minors and compliance with both domestic and international child-safety standards.

    Violations of this Section will result in immediate termination without refund and may lead to criminal prosecution under applicable local, state, or federal laws of the United States, as well as under any applicable foreign, national, and international laws and regulations, including the laws of the countries where SCALIBIT’s servers, data centers, and infrastructure are physically located. Customers, resellers, and sub-account holders must immediately disable or remove any accounts, users, or content found to be in violation; failure to do so may result in suspension or termination of the related parent or reseller account.

    In accordance with 18 U.S.C. § 2258A, SCALIBIT will report any actual knowledge of apparent violations of 18 U.S.C. §§ 2251, 2251A, 2252, 2252A, 2252B, 2260, or 1466A to the CyberTipline. Do not send any suspected images directly to SCALIBIT. Instead, report suspected CSAM or related content hosted on SCALIBIT to abuse@scalibit.com with the relevant URL or file path, victim (if known), date of birth or creation, and contextual information. Reports involving sites not hosted by SCALIBIT should be directed to law enforcement or reputable organizations such as ASACP.

    22. U.S. EXPORT LAWS AND SANCTIONS COMPLIANCE

    Use of the Services by you and/or your End Users is subject to U.S. export control, re-export, and economic sanctions laws and regulations, including but not limited to those administered by the U.S. Department of Commerce, the U.S. Department of the Treasury’s Office of Foreign Assets Control (“OFAC”), the U.S. Department of State, and other United States authorities (“U.S. Export Laws”).

    You may not use, access, host, resell, or provide SCALIBIT Services in violation of any U.S. Export Laws, including to or for the benefit of any individual, entity, or country that is embargoed, sanctioned, or otherwise restricted. This includes, without limitation, Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk People’s Republic (DPR), or Luhansk People’s Republic (LPR) regions of Ukraine.

    You represent and warrant that (i) you are not located in, under the control of, or a national or resident of any restricted country or region; (ii) you are not listed on any U.S. Government list of prohibited or restricted parties, including the U.S. Treasury Department’s Specially Designated Nationals (“SDN”) List, the Sectoral Sanctions Identifications (“SSI”) List, or the U.S. Commerce Department’s Denied Persons List; and (iii) you will not directly or indirectly use, export, re-export, transfer, divert, or otherwise provide SCALIBIT Services in violation of these laws and regulations.

    Users shall not collect, store, transmit, or host any software, technical data, or information that is subject to export restrictions under U.S. law. If you are or become a sanctioned person or entity, or if SCALIBIT determines that your use of the Services may cause it to violate applicable sanctions laws, SCALIBIT may immediately suspend or terminate your account without notice or refund.

    You further agree not to use the Services in connection with any activities involving nuclear, missile, chemical, or biological weapons proliferation, or in violation of any applicable non-proliferation or arms control regulations under U.S. or international law.

    Additionally, SCALIBIT prohibits the use of its Services with, or in connection to, any Country-Code Top Level Domain Name (“ccTLD”) associated with a sanctioned country or region (for example: .ir, .kp, .sy, .cu, .su, or equivalent), unless explicitly authorized in writing by SCALIBIT.

    If you access SCALIBIT Services from other countries or jurisdictions, you are responsible for ensuring full compliance with the laws of that jurisdiction, provided such laws do not conflict with U.S. Export Laws. In the event of any conflict, U.S. Export Laws shall prevail.

    23. IP ADDRESSES

    IP numbers and address space used with the Services are owned or administratively controlled by SCALIBIT and/or its verified data center partners or upstream network providers and are licensed to you for use with the Services during your active service term. All assigned IPs constitute temporary, non-transferable usage rights and do not imply ownership. IP addresses may not be sold, assigned, transferred, pledged, or sub-licensed. Upon cancellation or termination of Services, all IPs are recycled or reassigned in accordance with TOS §§14 and 34. During suspension (TOS §32.10.1), IPs are not reassigned but may change upon reactivation.

    SCALIBIT reserves the right to modify, replace, or withdraw any assigned IP address(es) for operational, network management, or provider-related reasons — including but not limited to upstream IP block changes, routing adjustments, abuse mitigation, or compliance with Regional Internet Registry (RIR) policies. Where practicable, prior notice will be provided. You acknowledge that such IP changes may require configuration updates or propagation, and SCALIBIT shall not be liable for any related delays or third-party caching issues.

    You must comply with applicable RIR policies (e.g., ARIN, RIPE NCC, APNIC, AFRINIC, LACNIC) regarding justification and utilization. If you order multiple IP addresses for: Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute (Standard, High Performance, High Frequency), Optimized Cloud Compute (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), or Dedicated Servers (Dedicated/Bare Metal), you must maintain the required utilization thresholds as outlined in TOS §14 (IP Addresses). SCALIBIT may reclaim under-utilized or abused addresses to maintain compliance with RIR and internal allocation policies.

    If you use your own IP address space announced through SCALIBIT’s network or a verified data center partner (via BGP/AS under Letter of Authorization), or lease SCALIBIT-owned IP address space for use within or outside SCALIBIT’s network, such usage is governed by TOS §§14.3.1–14.3.2. All activity, routing, and traffic associated with such IP space remain the sole responsibility of the Customer. Any violation of applicable law, RIR policy, or this AUP may result in immediate suspension or permanent revocation of IP assignments without refund.

    Customers leasing or announcing SCALIBIT-owned IP space externally (for example, via BGP in third-party data centers) must ensure compliance with SCALIBIT’s IP Address Services Policy and any executed IP Lease Agreement. SCALIBIT reserves the right to withdraw, null-route, or isolate externally announced IP space in the event of abuse, violation, or verified legal request from competent authorities. All IP leasing and external routing remain subject to contractual verification, RIR compliance, and SCALIBIT’s approval.

    Customers are fully responsible for all activity originating from their assigned IPs, including any actions by employees, contractors, resellers, or end users. You must maintain correct DNS and reverse DNS (PTR) settings and reasonable email hygiene (SPF, DKIM, DMARC). Reverse DNS delegation is provided at SCALIBIT’s discretion and may require verification or justification; requests may be denied or revoked in cases of suspected abuse or policy non-compliance. Shared Web Hosting environments are excluded from rDNS customization unless otherwise stated.

    All assigned IP addresses must be used in accordance with SCALIBIT’s Acceptable Use Policy, RIR policies, and all applicable local, state, and federal laws of the United States, as well as relevant foreign, national, and international laws — including those of the countries where SCALIBIT’s servers, data centers, or partner infrastructure are physically located. Violations may lead to immediate suspension or permanent revocation of IP assignments.

    You are expressly prohibited from operating VPN, proxy, Tor exit, anonymization, or similar relay services that conceal identity for illegal, abusive, or fraudulent purposes — including identity masking, IP obfuscation, geographic misrepresentation, or law enforcement evasion. Use of SCALIBIT IPs to conceal or misrepresent user identity or origin constitutes a material breach of this AUP.

    You must not engage in IP spoofing, operate open relays or proxies, or perform network abuse such as unsolicited email, scanning, brute-force, malware distribution, or command/control. Violations may result in filtering, null-routing, suspension, or termination under this AUP and the Terms of Service.

    Email & Reputation: You are responsible for the deliverability and reputation of your assigned IPs. SCALIBIT is not liable for third-party blocklisting (e.g., Spamhaus, Barracuda, Proofpoint, UCEPROTECT, RIPE Abuse). Where remediation is feasible, administrative or third-party delisting costs may apply. SCALIBIT makes no guarantee of successful delisting or future deliverability.

    SCALIBIT shall not be liable for any illegal activity, offense, or civil claim arising from the use or misuse of IP addresses under any service type — including Shared Web Hosting, Virtual Machines, Cloud Services, Cloud Compute, Optimized Cloud Compute, or Dedicated Servers. All legal, regulatory, and financial liability rests solely with the Customer assigned or leasing the IP space.

    In accordance with applicable law, SCALIBIT may disclose customer identification data, account activity, or routing records in response to valid, verifiable requests or binding orders from competent law enforcement or regulatory authorities. Such cooperation extends to customer-announced or leased IP space and is limited to the minimum scope required by law, with full compliance under privacy and data-protection frameworks.

    Use of SCALIBIT IPs and Services must be lawful at all times. Any illegal, abusive, or unethical activity — whether by the Customer, its employees, or downstream users — may result in immediate suspension, null-routing, or termination. SCALIBIT reserves the right to cooperate with competent authorities in accordance with U.S. federal and state laws, applicable foreign or international regulations, and recognized cross-border frameworks.

    Nothing in this Section obligates SCALIBIT to provide a dedicated IP. Dedicated IPs (where available) are subject to eligibility, justification, and additional fees, and may be denied if RIR or internal compliance requirements are not met.

    Customer Responsibility: Use of assigned IPs is further governed by AUP §24 (Customer Responsibilities) and TOS §30 (Abuse, Spam & Enforcement; Liquidated Damages).


    24. CUSTOMER’S RESPONSIBILITIES

    You are responsible for ensuring that all materials, content, or activities conducted through your Services comply with this Acceptable Use Policy (AUP), the Terms of Service (TOS), and all applicable local, state, and federal laws of the United States, as well as all applicable foreign, national, and international laws and regulations — including those of the countries where SCALIBIT’s servers, verified data center partners, and network infrastructure are physically located. This responsibility extends to materials or actions performed by your employees, contractors, resellers, end users, or any third parties acting under your account or IP space.

    SCALIBIT does not review, edit, or pre-screen the content hosted or transmitted through its network. Accordingly, SCALIBIT assumes no liability for inaccurate, inappropriate, offensive, or illegal material or transactions distributed by Customers or their End Users. You are solely responsible for all content, data, and network activity associated with your account or assigned IP addresses.

    Use of SCALIBIT Services requires a reasonable level of technical knowledge in Internet protocols, DNS, security, and server management. You acknowledge that you possess or will obtain the skills required to manage your Services appropriately. SCALIBIT is not responsible for providing training or consultancy beyond the scope of standard support described in the TOS.

    Services and Assigned IP Addresses. You are solely responsible for the lawful and proper use of your Services, including all activities conducted through any assigned IP addresses. This includes ensuring compliance with all technical, security, and policy obligations described herein. Without limitation, you agree to:

    • Comply with this Agreement (AUP and TOS), applicable laws and regulations (e.g., anti-spam, data protection, export/sanctions), and applicable Regional Internet Registry (RIR) policies (e.g., ARIN, RIPE NCC) regarding IP justification and utilization (see TOS §§14 & 30).

    • Maintain accurate DNS and reverse DNS (PTR) configurations, where applicable, and reasonable email authentication practices (SPF, DKIM, DMARC). Deliverability, blocklisting, and IP reputation are your sole responsibility. Remediation or delisting actions may incur administrative and third-party fees (see TOS §30).

    • Keep systems updated and secured, protect credentials and access keys, promptly remediate vulnerabilities, and ensure no operation of open relays, proxies, or anonymizers. You must not engage in IP spoofing, unsolicited bulk/commercial email, brute-force, malware distribution, or network scanning (see AUP – Prohibited Uses).

    • Honor the non-transferability and reassignment rules of IP addresses (see TOS §30), and maintain the minimum utilization threshold for any multiple allocations (see TOS §14).

    • Maintain independent, off-site backups of all critical data at all times; restores are not guaranteed (see TOS §§25.1 / 25.2).

    • Promptly respond to abuse or security notifications and cooperate during investigations. Failure to respond or remediate within a reasonable timeframe may result in filtering, rate-limiting, null-routing, suspension, or termination in accordance with TOS §§32.10.1 and 34.

    You must not use the Services to transmit, host, or engage in any illegal, harmful, fraudulent, or offensive activity. This includes, but is not limited to: gambling, adult/pornographic content, CSAM, warez, torrent/P2P, phishing, malware, spam, counterfeit goods, or hate-inciting material. You are responsible for ensuring full compliance with applicable laws both in your jurisdiction and in the jurisdiction where the server or data center is located.

    The responsibilities described in this Section apply to all SCALIBIT Services, including but not limited to: Shared Web Hosting (cPanel Hosting, CWPpro Hosting, WordPress Hosting), Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute (Standard Performance, High Performance, High Frequency), Optimized Cloud Compute (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), and Dedicated Servers (Dedicated or Bare Metal). All Services must be used solely for lawful, ethical, and legitimate purposes in compliance with applicable law.

    You are responsible for maintaining the security of your accounts, websites, and hosted applications. You must keep all software, scripts, and plugins up to date; use strong, unique passwords; and apply secure permissions (e.g., 711 for directories, 600 for configuration files). Failure to implement reasonable security measures may result in service suspension or termination.

    SCALIBIT may, upon receipt of an official, lawful, and verifiable request from competent authorities (including but not limited to law enforcement, regulators, or courts), provide account or network data as required by applicable law. Such disclosures are limited to the minimum scope necessary to satisfy the request and always conducted in compliance with applicable privacy, data protection, and judicial cooperation laws.

    You are responsible for ensuring that domain name registrations, IP allocations, or content hosted under your account do not infringe third-party rights, including trademarks, copyrights, or other intellectual property. Registrant and contact data may be shared with ICANN, registries, or lawful authorities as required by applicable regulations.

    25. CUSTOMER RESPONSIBILITY FOR CUSTOMER’S USERS

    Each SCALIBIT Customer is fully responsible for the actions and activities of its representatives, employees, resellers, contractors, and End Users (collectively, “Users”). By accepting Services from SCALIBIT, you agree to ensure that all Users comply with this Acceptable Use Policy (“AUP”), the Terms of Service (“TOS”), and all applicable local, state, and federal laws of the United States, as well as all applicable foreign, national, and international laws and regulations — including those of the countries where SCALIBIT’s servers, verified data center partners, and network infrastructure are physically located. This includes compliance with laws covering data protection, cybersecurity, telecommunications, and intellectual property rights.

    If you provide or resell SCALIBIT Services (including but not limited to Shared Web Hosting (cPanel Hosting, CWPpro Hosting, WordPress Hosting), Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute (Standard, High Performance, High Frequency), Optimized Cloud Compute (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), Dedicated Servers (Dedicated Servers or Bare Metal), Domain Registration, SSL Certificates, or IP Address Resources (leased, assigned, or announced IPv4/IPv6 ranges)), you must establish and enforce your own Terms of Use or Acceptable Use Policy consistent with SCALIBIT’s AUP and TOS. You are responsible for promptly responding to and resolving all abuse, security, or legal complaints related to your Users’ activities, including any misuse or unlawful conduct involving assigned or announced IP addresses.

    Complaints concerning violations by your Users may be forwarded to your designated abuse or postmaster contact for immediate review. You must cooperate fully with SCALIBIT in investigating and mitigating any reported violations or abuse originating from your account or Users.

    If SCALIBIT determines, in its sole discretion, that you or your Users have violated this AUP, or if your Users’ activities create risk, harm, or liability to SCALIBIT, its network, or other customers, SCALIBIT reserves the right to suspend or terminate the affected Services, apply network restrictions (including null-routing or filtering), or take other appropriate remedial actions without prior notice.

    You acknowledge that SCALIBIT may, upon receipt of an official, lawful, and verifiable request from competent authorities, report unlawful activities or cooperate with investigations related to your account or your Users’ actions. All such cooperation is limited to the minimum scope required by applicable law and jurisdiction and will always comply with relevant privacy and data protection frameworks.

    If you lease, announce, or otherwise use IP address space provided by SCALIBIT or your own IP resources announced through SCALIBIT’s network (AS number), you are fully responsible for ensuring compliance with applicable Regional Internet Registry (RIR) policies (e.g., ARIN, RIPE NCC) and SCALIBIT’s Acceptable Use Policy. This includes maintaining valid justification for IP assignments, preventing abuse, and ensuring that all traffic routed via such IP space complies with local, state, and federal U.S. laws and all applicable foreign and international regulations — including those related to cybercrime, data protection, and network security.

    Customers who provide their own IP address resources (IPv4/IPv6 ranges) for announcement via SCALIBIT’s infrastructure must retain ownership and administrative control of those addresses, provide proof of assignment or authorization, and grant SCALIBIT a limited right to announce the IP space solely for the duration of the active service. SCALIBIT shall not be liable for routing, reachability, or reputation issues resulting from third-party actions or RIR disputes. In cases of abuse or regulatory violation, SCALIBIT reserves the right to suspend, filter, or withdraw any IP announcement to ensure compliance with applicable law and policy.

    For additional details regarding user responsibilities, enforcement, and cooperation with competent authorities, please refer to TOS §§10, 15, 16, 30, and 38. These sections collectively define customer obligations, prohibited conduct, enforcement mechanisms, and SCALIBIT’s law enforcement cooperation framework.

    26. DISCLOSURE OF INFORMATION

    We may disclose information, including information that you or your End Users may consider confidential, in order to comply with a court order, subpoena, summons, discovery request, warrant, regulation, or governmental request. We have no obligation to inform customers or End Users that this information has been disclosed, and in some cases may be prohibited by law from doing so. We may also disclose such information when necessary to protect SCALIBIT, its customers, or the public from harm or unlawful activity.

    SCALIBIT may, without prior notice to the Customer, (i) report to the appropriate authorities any conduct by the Customer or its End Users that SCALIBIT reasonably believes violates applicable law; and (ii) provide any relevant information to law enforcement, regulatory agencies, or civil authorities in response to an official and verifiable request, subpoena, or other lawful process that on its face meets the legal requirements for such disclosure.

    SCALIBIT cooperates fully with authorized governmental and law enforcement bodies (including but not limited to Police, Prosecutor’s Offices, Courts, and Cybercrime Units) as required by applicable law or investigation procedures. Such cooperation may include the disclosure of customer identification data, order and payment records, service configuration details, IP address allocation, routing, and usage logs, or — when lawfully requested — server or system image copies. This includes data related to customer-announced IP space (under LOA/BGP) or SCALIBIT-owned IP space leased to third parties in accordance with TOS §§14.3.1–14.3.2. All disclosures are strictly limited to the scope necessary to fulfill legal or regulatory obligations.

    In cases involving cybercrime, fraud, abuse, or illegal network activity, SCALIBIT may immediately suspend or terminate affected services, including IP assignments or routing announcements, without refund. This applies equally to Customer-owned IPs announced via SCALIBIT’s infrastructure and to SCALIBIT-owned IPs leased or routed through third-party data centers. SCALIBIT reserves the right to null-route or withdraw such IP space where required by law, RIR policy, or to preserve network integrity.

    SCALIBIT maintains detailed internal audit logs of all disclosure actions to ensure compliance with applicable data protection and privacy regulations, including but not limited to the General Data Protection Regulation (GDPR), California Consumer Privacy Act (CCPA), Law on the Protection of Personal Data (KVKK), and other relevant international or national frameworks. SCALIBIT does not process, access, or disclose customer information beyond what is legally required or justified under these laws.

    For transparency and security, SCALIBIT reviews all legal or governmental data requests to confirm validity and jurisdiction before disclosing any data. Where legally permissible, SCALIBIT may notify affected customers after disclosure. In certain cases, such notification may be delayed or prohibited by law.

    SCALIBIT may also cooperate with competent international law enforcement agencies, data-protection authorities, or cross-border regulatory bodies acting under mutual legal assistance treaties (MLATs), international conventions, or equivalent frameworks. Such cooperation shall be conducted strictly within the limits of applicable international law and privacy regulations, and limited to the minimum scope necessary to fulfill lawful obligations.

    As a United States–based company providing hosting and infrastructure services across multiple international regions, SCALIBIT may receive lawful requests for information from authorities in countries where its servers, data centers, or IP address resources are physically located. In such cases, SCALIBIT may disclose limited customer information — strictly within the bounds of applicable privacy and data-protection laws — to competent local authorities when required by law, court order, or official investigation. All disclosures are handled in compliance with confidentiality obligations, data-sovereignty principles, and applicable international cooperation frameworks.

    SCALIBIT does not maintain or store customer administrative credentials, encryption keys, or full data backups except where technically necessary or legally required. In the event of a lawful, verifiable request from competent authorities (such as a court order or prosecutor’s directive), SCALIBIT may perform limited technical actions — such as credential resets or system access — solely to comply with that legal obligation. All such actions are logged, audited, and limited to the minimum scope required by law.

    SCALIBIT does not sell, trade, or otherwise disclose customer data to any third party except as required by law or as necessary to provide the contracted Services. All government or law enforcement requests are carefully reviewed by SCALIBIT’s Legal & Compliance team to ensure validity and proportionality before any data is released.

    27. OTHER ABUSE

    The use and misuse of Internet services evolves over time. SCALIBIT reserves the right to determine, in its sole discretion, what constitutes abusive or unacceptable use of its Services, network, or infrastructure. If we determine that your use of our Services negatively impacts our ability to provide services to other customers, may subject us to liability, indicates your unfamiliarity with proper use of the Services, or if you abuse our support staff, we may suspend or terminate your account without prior notice.

    Examples of “Other Abuse” include, but are not limited to:

    • Excessive or abnormal consumption of CPU, memory, disk I/O, or bandwidth that disrupts service quality for other users.

    • Improper configuration, insecure scripts, or unoptimized applications that cause service degradation, instability, or denial of service.

    • Using outdated, unpatched, or vulnerable software resulting in compromise, spam generation, or abuse incidents.

    • Running unauthorized monitoring, crawling, scanning, or stress-testing tools on SCALIBIT or third-party systems.

    • Operating cryptocurrency mining, crypto-farming, or similar resource-intensive workloads without explicit authorization.

    • Engaging in harassment, intimidation, or abusive behavior toward SCALIBIT staff through support tickets, live chat, or email communication.

    • Repeatedly submitting unfounded or bad-faith abuse, billing, or technical complaints that disrupt normal support operations.

    SCALIBIT may, at its discretion, issue warnings, apply resource limitations, suspend affected services, or terminate the account in cases of repeated or serious violations. Immediate action may be taken if the abuse poses a risk to SCALIBIT’s systems, other customers, or network stability. No refunds or service credits shall be issued in connection with abuse-related suspensions or terminations.

    Persistent failure to maintain secure and compliant configurations, or any conduct deemed harmful to SCALIBIT’s operations, security, or reputation, may result in permanent service termination and refusal of future service. SCALIBIT maintains internal audit and abuse detection logs to ensure the fairness and accuracy of enforcement actions and to comply with applicable data-protection and privacy obligations.

    28. ACCOUNT CONTACT DETAILS & COMMUNICATION RESPONSIBILITIES

    From time to time, SCALIBIT may need to communicate with you regarding billing matters, service updates, network maintenance, policy changes, or important notifications related to your account. It is your responsibility to provide SCALIBIT with accurate, up-to-date, and actively monitored contact information, including a valid email address and (where applicable) a valid billing contact.

    You must promptly update your contact details through your client area or by notifying our billing department if any of the following change: your primary contact name, company name, billing address, email address, or phone number. SCALIBIT has no responsibility for communications that are delayed, misdirected, or not received as a result of your failure to maintain accurate account information.

    Official communications from SCALIBIT, including billing reminders, suspension notices, service renewals, or abuse reports, will be sent via email to the address on record. These messages are considered delivered once transmitted to that address. You are responsible for monitoring your email and ensuring that SCALIBIT messages are not filtered, blocked, or marked as spam.

    Email shall be considered the primary and official method of communication between SCALIBIT and the Customer for all service-related matters, including invoices, renewal notifications, and policy updates. SCALIBIT may, at its discretion, also issue notices via its client portal or other digital channels; however, email delivery to the address on record remains the legally recognized point of contact.

    If you require assistance or wish to update your contact information, please contact our Billing or Support team through the official client area or by emailing support@scalibit.com. Abuse or security-related communications should be directed to abuse@scalibit.com.

    Any misuse of SCALIBIT’s contact channels — including but not limited to the transmission of spam, threats, or unsolicited bulk messages to SCALIBIT staff — constitutes a violation of this Policy and may result in account suspension or legal action.

    29. ABUSE TICKETS

    SCALIBIT’s standard procedure in the event of a violation of this Acceptable Use Policy (AUP) or the Terms of Service (TOS) is to contact the Customer and provide notice of the alleged violation. However, SCALIBIT reserves the right to suspend, restrict, or terminate any account, with or without prior notice, at its sole discretion when necessary to protect its network, infrastructure, or other customers.

    The Customer agrees to maintain accurate and up-to-date primary contact information, including a monitored email address. All abuse-related notifications issued by SCALIBIT will be sent from abuse-notice@scalibit.com and are delivered as ticket messages in our client portal. The subject line will specify the violation type and any case identifier, and the message body will include details of the incident, the affected IP(s) or service(s), evidence (where applicable), and a defined remediation window. Abuse reports received from the public or third parties should be sent to abuse-reports@scalibit.com.

    Once an abuse notification has been sent to the registered contact address (and posted to the client portal), it shall be considered received and acknowledged by the Customer. It is the Customer’s responsibility to monitor the ticket, respond promptly, and take corrective action within the timeframe specified by SCALIBIT. Failure to receive messages due to filtering or blocking will not excuse non-compliance.

    SCALIBIT reserves the right to determine the response time on a case-by-case basis, generally allowing between zero (0) and forty-eight (48) hours for the Customer to remediate the issue, depending on severity. In critical or high-risk cases (e.g., spam campaigns, phishing, malware distribution, DDoS attacks, compromise), immediate suspension or network mitigation may occur without prior notice and without any refund or service credit.

    If the abuse issue is not resolved in a timely manner, SCALIBIT may take appropriate actions to protect its infrastructure and reputation. These actions may include, but are not limited to: temporary IP null-routing, port blocking, traffic filtering, service suspension, data access restriction, or permanent service termination.

    Resellers must promptly pass abuse notices to affected downstream users and ensure remediation within the stated deadlines. Repeated or severe abuse incidents, failure to cooperate with investigations, or use of SCALIBIT Services for unlawful or harmful purposes may result in permanent account closure and refusal of future service. All enforcement and communication actions under this Section are recorded in internal audit and abuse logs for accountability, compliance, and transparency purposes.

    Questions or appeals regarding an abuse ticket should be submitted by replying to the ticket in the client portal or, if necessary, by emailing abuse@scalibit.com with the case ID in the subject line.

    30. OTHER

    30.1 Domain Names & Associated Services

    You must maintain valid, complete, and up-to-date contact information with your domain registrar for any domain hosted on the SCALIBIT network. This includes, without limitation, accurate registrant, administrative, and technical contact details as required under ICANN rules and applicable registry policies.

    Failure to maintain accurate domain registration information may result in suspension or deletion of the domain by the registrar or registry, which may cause your services (including websites, email, or SSL certificates) to become inaccessible. SCALIBIT is not responsible for downtime, data loss, misconfiguration, or any other service impact resulting from incorrect, outdated, or missing WHOIS information.

    You are also responsible for timely renewal of your domain names, SSL certificates, and other associated services. SCALIBIT bears no responsibility for the loss, expiration, or involuntary transfer of any domain name or SSL certificate due to your failure to renew on time or maintain valid payment details. Renewal reminders (if provided) are sent as a courtesy only and do not constitute a legal obligation on SCALIBIT’s part.

    SCALIBIT acts solely as a technical intermediary for domain registration and related DNS or SSL operations and does not guarantee registration approval, renewal, or restoration by the relevant registry or registrar. All domain-related transactions are governed by the respective registry and registrar terms, as well as ICANN policies.

    30.2 SSL Certificates & Renewals

    Customers are responsible for ordering, installing, and maintaining valid SSL/TLS certificates for their domains and hosted services. SCALIBIT provides both complimentary (AutoSSL / Let’s Encrypt) and paid SSL certificate options. All certificates are issued subject to the validation and issuance policies of the respective Certificate Authorities (CAs).

    30.2.1 Free SSL Certificates (AutoSSL / Let’s Encrypt)

    Free SSL certificates provided through SCALIBIT’s Shared Web Hosting platforms (cPanel Hosting, CWPpro Hosting, and WordPress Hosting) are offered as a courtesy feature via automated systems such as AutoSSL or Let’s Encrypt. SCALIBIT does not guarantee issuance, renewal, or validity of these certificates. Domain validation errors, DNS misconfigurations, expired WHOIS data, or user-side issues may cause SSL generation or renewal failures.

    SCALIBIT assumes no liability for downtime, browser warnings, or loss of service resulting from expired or invalid free SSL certificates. Customers may at any time install their own paid SSL certificates to maintain continuous encryption and uptime.

    30.2.2 Paid SSL Certificates (Commercial SSL)

    Paid SSL certificates purchased through SCALIBIT are issued by trusted Certificate Authorities (CAs) and are intended for professional or enterprise use. Once an SSL certificate has been successfully issued, all sales are final and non-refundable, regardless of future cancellation, service termination, or domain changes. SCALIBIT does not offer replacements, exchanges, or refunds for SSL certificates once issued or activated.

    SCALIBIT provides assistance with installation and renewal for SSL certificates purchased through its platform; however, it is the Customer’s responsibility to ensure timely renewal, correct installation, and maintenance of a valid SSL/TLS configuration. SCALIBIT is not liable for downtime, validation failure, or data loss caused by expired, revoked, or misconfigured SSL certificates.

    SCALIBIT reserves the right to revoke, disable, or refuse renewal of any SSL certificate used for malicious, fraudulent, or policy-violating purposes — including phishing, impersonation, or malware distribution — without refund.

    31. DISCLAIMER

    SCALIBIT is under no obligation to monitor or actively supervise user activity and disclaims any responsibility for misuse of the Services by Users, Customers, or their End Users. SCALIBIT assumes no responsibility for any material, data, content, or information created, stored, maintained, transmitted, or otherwise made available through the Services by any User or third party, and is not obligated to monitor, review, or exercise editorial control over such material.

    If SCALIBIT becomes aware that any such material violates this Acceptable Use Policy, the Terms of Service, or applicable law, and/or may expose SCALIBIT to civil or criminal liability, SCALIBIT may, but is not required to, block access to such material, disable related services, suspend or terminate the relevant account(s), and/or report the matter to appropriate authorities. Unless otherwise expressly stated, SCALIBIT disclaims any obligation or liability to any person or entity that has not entered into a valid service agreement with SCALIBIT.

    All Services are provided on an “as is”, “as available”, and “with all faults” basis. SCALIBIT, its officers, directors, employees, agents, and verified data center partners, as well as third-party service providers, expressly disclaim all warranties — statutory, express, or implied — including, without limitation, implied warranties of title, merchantability, fitness for a particular purpose, and non-infringement. SCALIBIT makes no representation or warranty regarding the accuracy, completeness, or reliability of any data, system, or information transmitted through or hosted on its network.

    You acknowledge that your use of the Services is at your sole risk. Any data, material, or information downloaded or obtained through the Services is done at your own discretion and risk, and you are solely responsible for any damage, data loss, or corruption resulting therefrom. No oral or written advice or information provided by SCALIBIT or its representatives shall create any warranty or representation not expressly stated herein.

    This disclaimer also extends to all SCALIBIT-provided infrastructure components, including, without limitation, network services, routing systems, and IP address allocations (whether SCALIBIT-owned, leased to Customer, Customer-owned and announced via BGP, or routed through partner data centers/networks). SCALIBIT assumes no responsibility for any misuse, abuse, or unlawful activity conducted through these resources by Customers, their end users, or third parties. Nothing in this section limits SCALIBIT’s enforcement rights under TOS §30 or the obligations and responsibilities set forth in TOS §14 (IP Addresses) and AUP §23/§26.

    To the extent permitted by applicable law, no oral or written statement by SCALIBIT or its affiliates shall modify this disclaimer. This disclaimer shall apply to the fullest extent permitted by law and shall survive the termination or expiration of your use of the Services.     32. SCALIBIT'S RIGHTS

    SCALIBIT reserves the right at all times to investigate any actual, suspected, or alleged violations of this Acceptable Use Policy (AUP), the Terms of Service (TOS), or applicable law. You shall reasonably cooperate with SCALIBIT in investigating, mitigating, and correcting any actual or alleged breach of this AUP by yourself, your Users, or third parties acting through your systems or IP space.

    SCALIBIT further reserves the right to cooperate fully with law enforcement agencies, regulatory authorities, upstream providers, and other affected parties in investigating any alleged or potential violations. Such cooperation may include disclosure of relevant account, network, or contact information consistent with SCALIBIT’s Privacy Policy and Information Request procedures. SCALIBIT may also implement technical or administrative mechanisms to prevent, detect, or remediate AUP violations, security threats, or network abuse.

    At its sole discretion, SCALIBIT may suspend, restrict, or terminate Services, apply network filters, revoke IP assignments, or take any other technical or legal action it deems necessary to protect its infrastructure, reputation, or other customers from harm. Such actions may include, without limitation, temporary traffic filtering, null-routing of affected IP addresses, withdrawal of BGP announcements, or rate-limiting measures at the network edge. Nothing in this AUP limits SCALIBIT’s rights or remedies available under applicable law or equity, including the right to recover damages, seek injunctive relief, or refer matters to competent authorities.

    33. AUTHORIZED & LAWFUL USE

    You agree to:

    • (i) Comply with this Acceptable Use Policy (AUP), the Terms of Service (TOS), the Privacy Policy, and any other applicable SCALIBIT policies, procedures, or technical guidelines;

    • (ii) Comply with all applicable local, national, and international laws and regulations, including, without limitation, those relating to data protection and privacy, intellectual property, export control, economic sanctions, tax compliance, and criminal or cybercrime legislation;

    • (iii) Use the Services in a lawful, ethical, and professional manner, ensuring the integrity, confidentiality, and availability of SCALIBIT’s systems, networks, and customer environment at all times;

    • (iv) Ensure that all End Users, clients, or resellers under your account comply with these same obligations, and promptly address any violation or abuse reported by SCALIBIT or external parties.

    You are solely responsible for ensuring that your use of the Services—and that of your End Users—complies with all applicable laws in your jurisdiction, in the jurisdiction of the server or data center location, and in any country where your data, network traffic, or users may transit or reside.

    SCALIBIT reserves the right to suspend, restrict, or terminate Services without prior notice if unlawful, unethical, or abusive activity is detected. Such enforcement may include disabling access, null-routing affected IP addresses, or reporting the activity to competent authorities when required by law.

    34. CONSEQUENCES OF VIOLATION OF AUP

    Your Services may be suspended or terminated, with or without prior notice, upon any violation of this Acceptable Use Policy (AUP) or the Terms of Service (TOS). Violations may also be reported to the appropriate law enforcement, prosecutorial, judicial, or regulatory authorities, as required or permitted by applicable law.

    If we determine, in our sole discretion, that you or your End Users have violated this AUP, we may remove, disable access to, or modify any content, data, or resource, and/or suspend or terminate your use of the Services. We may also intercept, filter, rate-limit, null-route, or block any traffic or content associated with your Services that is being used unlawfully or in violation of this AUP. Our right to suspend or terminate Services applies even if the violation is committed unintentionally or without your authorization. Such rights are discretionary, and SCALIBIT may exercise them at any time without obligation to act on every occurrence.

    Upstream & Network Safeguards. To protect network integrity, SCALIBIT and/or its upstream providers may immediately implement technical controls without prior notice, including but not limited to: IP black-holing/null-routing, BGP route withdrawal, port blocking, traffic filtering, or temporary removal of routing announcements. Where applicable, IP assignments may be reclaimed pursuant to TOS §14 (IP Addresses).

    Preservation & Forensics. We may preserve relevant logs, snapshots, routing data, or other records, isolate affected systems, and perform forensic analysis to investigate and mitigate abuse. Where required by law, we cooperate with competent authorities and honor lawful data-preservation requests.

    In addition to any other remedies available, SCALIBIT may charge you its standard hourly rates, reasonable legal fees, and any associated costs (including materials and technical labor) incurred while investigating, responding to, or remediating any violation of this AUP by you or your Users. These costs may include, without limitation: third-party delisting/remediation fees (e.g., RBL blocklist removals), upstream provider charges, emergency response/mitigation fees, and recovery of damages to SCALIBIT’s systems or reputation.

    A failure to respond to an email or ticket from our Abuse Department (abuse-notice@scalibit.com) within forty-eight (48) hours—or within the specific timeframe stated in the communication—may result in suspension or termination of your Services. Abuse issues must be handled via ticket or email and will generally receive a response within forty-eight (48) hours.

    No Refunds; SLA Exclusions. Suspensions, restrictions, or terminations resulting from AUP/TOS violations (or investigations into suspected violations) are ineligible for refunds, credits, or SLA remedies.

    Restoration of Service. Re-enablement is at SCALIBIT’s sole discretion and may require: (i) root-cause analysis and a written remediation plan, (ii) verifiable corrective actions (patching, configuration changes, access controls, abuse prevention), and (iii) payment of all outstanding fees, including any applicable reactivation charges.

    Responsibility for Sub-Users and End Clients. The Customer is fully responsible for all activity occurring under their account, including that of any sub-accounts, resellers, or end users. Violations originating from these entities shall be deemed violations by the Customer. SCALIBIT reserves the right to suspend or terminate any related service group if repeated or systemic abuse originates from customer-managed users or infrastructure.

    SCALIBIT cooperates fully with competent authorities, including but not limited to law enforcement agencies, prosecutors, courts, and cybercrime units, when required by applicable law or official investigation. Such cooperation may include providing relevant customer identification data, service information, or IP usage records to the extent permitted and required by law.

    35. REPORTING OF VIOLATIONS OF THIS AUP

    If you become aware of any suspected or actual violation of this Acceptable Use Policy (AUP), please promptly notify SCALIBIT by providing a full explanation and all relevant supporting information. Reports should include sufficient detail (such as IP address, timestamps, logs, or URLs) to allow for proper investigation. Insufficient, incomplete, or anonymous reports may not be processed.

    SCALIBIT may, at its discretion, request your cooperation or additional information to help verify, stop, or remedy the violation. Abuse complaints and related inquiries should be sent to our Abuse Department at:

    Reports received by SCALIBIT are reviewed and prioritized based on severity, potential harm, and impact to network stability or other customers. SCALIBIT reserves the right to take appropriate action, which may include suspension, termination, or referral to competent authorities in accordance with Section 34 of this AUP and the Terms of Service.

    By submitting a report, you acknowledge that SCALIBIT may share relevant portions of your report—including technical indicators or evidence—with affected customers, upstream providers, or law enforcement agencies as necessary for verification, mitigation, or compliance purposes. SCALIBIT does not guarantee individual responses to all reports but reviews each in accordance with internal abuse-handling procedures and applicable law.

    36. CHANGES TO THIS ACCEPTABLE USE POLICY

    SCALIBIT reserves the right to revise, amend, or update this Acceptable Use Policy (“AUP”) at any time, with or without prior notice. Unless otherwise stated, all modifications become effective immediately upon publication on SCALIBIT’s website.

    It is your responsibility to review this AUP periodically to remain informed of any changes. Continued use of the Services after the effective date of any update constitutes your binding acceptance of the revised version. If you do not agree to the updated terms, you must discontinue use of the Services.
