REQUESTS TO SCALIBIT FOR CUSTOMER DATA
SCALIBIT.COM ("SCALIBIT") is a provider of Hosting and Cloud services, and as such, we do not manage or control the data, content, or applications hosted from our infrastructure. Our customers are in care, custody and control over the data stored on the hosted system. Furthermore, many of SCALIBIT’s customers are Resellers of SCALIBIT services, and therefore, it is possible that the information you are seeking belongs to the customer of our customer.
The customers are fully responsible for the use, management, and content of the services they host on or utilize from our infrastructure. SCALIBIT only provides the technical infrastructure and does not oversee or control customer activities.
LEGAL INFORMATION REQUESTS
SCALIBIT only processes formal legal requests submitted via email. All legal inquiries must be sent to: legalrequests@scalibit.com.
SCALIBIT will only accept legal requests from authorized government entities. Requests sent to the wrong email address may result in delays.
All legal requests must include a clear justification for why the requested information is required. Requests must be based on a criminal offense, an ongoing legal investigation, or a court order. Arbitrary or legally unfounded requests will not be processed.
SCALIBIT evaluates requests strictly within the framework of legal regulations and respects its obligation to protect customer privacy.
REQUESTS FROM DOMESTIC AND INTERNATIONAL AUTHORITIES
SCALIBIT will prioritize requests from authorized institutions within our primary jurisdiction. Requests from international authorities will also be reviewed and considered in accordance with applicable laws and relevant international agreements.
REQUESTS
Please include as much detail as possible about the customer information you are seeking. The following are examples of items required by SCALIBIT to properly identify the customer:
- IP address(es)
- Domain/Website information
- Date(s)
- Full information about authority issuing the request for information
- The name and badge/ID of the responsible agent
- An official email address and contact phone number
- The description of the types of records you need
- The justification and legal basis for the request
Requests from government entities must be related to criminal activity, legal investigations, or valid court orders. Requests without a clear legal basis may be rejected.
SCALIBIT, respects the legal process, the law, and the privacy of its customers. Except as required by law or in the event of utilizing a third party vendor that is contractually prohibited from using personally identifiable information other than purposes for which their services are retained, SCALIBIT will not release customer information or customer account information to a third party without the express consent of its customer.
A valid legal request is required to compel SCALIBIT to disclose the identity or account information of a SCALIBIT customer.
The length of time data is retained varies based on the type of information and actions taken by the user. Generally, data from VPS Hosting, VDS Hosting, Virtual Machines, Cloud Server, Dedicated Cloud Server, Cloud Compute (Standard Performance, High Performance, High Frequency), Optimized Cloud Compute (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized) and Dedicated Server services is permanently removed upon deletion by the customer or upon a cancellation request. Customers also have control over the format (e.g., plain text, masked, or encrypted) and can delete or destroy server content at any time.
SCALIBIT has no authority or right to intervene over the content hosted by its customers in the scope of the services provided. Server content is entirely under the control of the customers and can only be managed, modified, or deleted by the customer. However, SCALIBIT reserves the right to take necessary action, including suspension or termination, in compliance with legal obligations or in cases of intellectual property violations.
The administrator/root credentials, other user account details, passwords, SSH port numbers, and similar confidential data related to the servers, services, and platforms used by customers are solely known by the customers and are not stored within SCALIBIT systems.
Customers using SCALIBIT's Dedicated Server services can erase their data, format their servers, or install a new operating system at any time through remote management panels (IPMI, iDRAC, iLO).
For Virtual Machines, Cloud, and Cloud Compute services, a new operating system can also be installed through the management panel. As a result, all previous data on the server is permanently deleted.
REQUESTS FROM GOVERNMENT AGENCIES/LAW ENFORCEMENT

Except in emergencies, SCALIBIT turns over protected user information only upon receipt of a valid legal request, or prosecutor's office request, or court request/order.

Upon receipt of a valid legal request, or prosecutor's office request, or court request/order, if these pieces of information are available, we can provide user registration information such as the first and last names, phone number, email address, IP address, the physical address.
The information related to our customers is provided by them during the registration process on our website.
SCALIBIT's Privacy Policies prohibits the release of customer or account information without express permission from the customer, except when required by law, to conform to the edicts of the law, or to comply with legal process properly served on SCALIBIT or one of its affiliates.
If you seek the identity or account information of a SCALIBIT customer in connection with a legal investigation, you must submit a valid legal request to SCALIBIT.
SCALIBIT strives to assist the law enforcement community while protecting the rights and privacy of its customers. SCALIBIT must comply with relevant laws when providing customer data.
All requested information must be submitted in writing only. Copies of accompanying “paper” legal documentation can be attached to the request. A legal request may be emailed to legalrequests@scalibit.com. Copies of accompanying “paper” legal documentation should be attached to the email request.
Legal Disclosure Policy: In non-emergency situations, SCALIBIT only discloses protected user information upon receipt of a valid legal, prosecutorial, or court request/order.
Response Time: Valid requests are handled in the order received, subject to pending expedited requests. Responsive information is generally provided within five (5) business days or on/before the time set forth in the request.

Notices: In accordance with the confidentiality provision within our Terms of Service, SCALIBIT will notify its customers of any request for their confidential information unless prohibited by law or pursuant to a Court Order.
