This Privacy Notice does not apply to the “content” processed, stored, or hosted by our customers using SCALIBIT Services in connection with an SCALIBIT account. PRIVACY NOTICE

This Privacy Notice (“Notice”), together with our cookie policy and other relevant legal notices posted on our website at www.scalibit.com, describes how The SCALIBIT.COM and its affiliates (collectively, “SCALIBIT”, “we”, or “us”) collects, stores, uses and discloses personal data (i.e., personal information) from and about you (“Customer”, “you(r),” or “User”) in connection with our Services, as defined in our posted Terms of Use. (together with all our posted policies and disclosures, the “Terms”).

SCALIBIT is a globally operating company specializing in web hosting, cloud, server solutions, and data center infrastructure. We provide a wide range of infrastructure-based services, including Shared Web Hosting (cPanel Hosting, CWPpro Hosting, WordPress Hosting), Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute (Standard Performance, High Performance, High Frequency), Optimized Cloud Compute (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), and Dedicated Servers / Bare Metal solutions (collectively, the “Services”).

  • This Notice does not apply to personal data in your User Content (as described in our Terms) such as on websites or other online services you host using our Services; in that context we operate solely as a data processor (i.e., service provider) subject to a Data Processing Agreement under our Terms.

  • You must accept our binding Terms in order to use our Services, and are strongly encouraged to read them in addition to this privacy policy.

  • For the avoidance of doubt, this Privacy Notice does not apply to the processing of your personal data by third parties whose websites are not owned and operated by us.

SCALIBIT complies with applicable privacy laws, including but not limited to the California Consumer Privacy Act (CCPA), the General Data Protection Regulation (GDPR) of the European Union, and Türkiye's Personal Data Protection Law (KVKK).

We may collect information about individuals by various means, including:

  • (1) directly from Users, both online (e.g., the Services) and offline (e.g., phone);

  • (2) through automated means when Users use our Services; and

  • (3) from third party sources, and from social media platforms that individuals may use to engage with us, for the purposes provided below and to supplement information we already possess.

For the purposes of this Privacy Notice, the individuals whose personal data is subject to data processing under this Privacy Notice, respectively the types of their personal data processed by us, may be categorised as follows:

Website Visitors

  • a. Definition: Individuals who visit our Site. For the avoidance of doubt, websites hosted by us but operated by our Customers are not part of the definition of Site. Our Site and Services may contain links to third-party websites, which are not under our control, and we are not responsible for their content. In the event that you follow a link to such pages, please note that there are other respective privacy policies that may apply and we do not have control over such pages. We encourage you to review the privacy policies of these parties before using such other websites.

  • b. Types of Personal Data Processed:

  • Contact Information - We may collect personal data such as first and last name, email address and other contact and personal information when you sign up for our newsletter, register and get access to a demo version of any of our Services (e.g demo version of our Site Tools), download materials from our Site, such as e-books, communicate, comment, review and/or discuss topics in the sections provided for this on our Site.

  • Personal Data Contained in Log Files - When you visit our Site we may process information such as your IP address, referral URL, exit URL, browser software, operating system, date/time and/or clickstream data.

  • Personal Data Collected Through Website Analytics Tools - We may collect information about your use of our Site, such as number of visits, pages visited, popularity of certain content. Analytics tools use tracking technologies (such as cookies) to recognise your device and compile information about you. They collect information such as what pages you visit and how much time you spend on these pages, the IP address assigned to you, what operating system and web browser you use, and what site you visited prior to visiting our Site.

Customers

  • a. Definition: Persons who enter into an agreement with us for the provision of Services.

  • b. Types of Personal Data Processed:

  • Customer Account Information - We process personal information such as first and last name, name of the legal entity and its legal representative, address, phone number, email address, language preferences, IP address, payment and billing information (i.e. credit card information and/or PayPal, Stripe account, personal or TAX identification number etc.), so you can place orders, request information, get support and use the Services. You may also opt to provide information about your Facebook and/or Twitter accounts.

  • Personal Data Contained in Log Files - When a Customer visits our Site we may process information such as IP address, referral URL, exit URL, browser software, operating system, date/time and/or clickstream data.

  • Personal Data Collected Through Website Analytics Tools - We may collect information about Customer’s use of our Site, such as number of visits, pages visited, popularity of certain content. Analytics tools use tracking technologies (such as cookies) to recognise the device used and compile the information. They collect information such as what pages the Customer visits and how much time the Customer spends on these pages, its IP address, what operating system and web browser the Customer uses, and what site the Customer visited prior to visiting our Site.

  • Other Types of Personal Data - When the Customer contacts us, including via any of our support channels, we may process the personal data provided to us (including voice) in order to deal with the Customer’s query. In addition, if the Customer loses access to its account, we may request certain documents in order to verify its identity. Those documents may contain personal data such as name, address, nationality, date of birth, identification document number, etc.

Users

  • a. Definition: Individuals who access and/or administer any of the Services for and on behalf of our Customers.

  • b. Types of Personal Data Processed:

  • User Information - We may process personal information such as first and last name, address, phone number, email address, so you can access and/or administer the Services, request information and get support.

  • Personal Data Contained in Log Files - When a User visits our Site we may process information such as IP address, referral URL, exit URL, browser software, operating system, date/time and/or clickstream data.

  • Personal Data Collected Through Website Analytics Tools - We may collect information about User’s use of our Site, such as number of visits, pages visited, popularity of certain content. Analytics tools use tracking technologies (such as cookies) to recognise the device used and compile the information. They collect information such as what pages the User visits and how much time the User spends on these pages, the IP address assigned to the User, what operating system and web browser the User uses, and what site the User visited prior to visiting our Site.

  • Other Types of Personal Data - When the User contacts us, including via any of our support channels, we may process the personal data provided to us in order to deal with the User’s query.

Registrants

  • a. Definition: Owners of domain names, registered with us.

  • b. Types of Personal Data Processed:

  • Domain Name Ownership Information - We process personal data such as first and last name, name of the legal entity and its legal representative, address, phone number and email address of the Registrants, as well as the domain name and its status, name server, IP address etc.

End Users

  • a. Definition: Individuals who visit, access, use and/or interact with our Customers’ websites.

  • b. Types of Personal Data Processed:

  • Personal Data Contained in Log Files - When an End User visits our Customer’s website we process End User’s information such as IP address, domain name, date, request method, URI user agent, referrer, TLS version, cache data.

Affiliates

  • a. Definition: Persons who participate in our Affiliate Program.

  • b. Types of Personal Data Processed:

  • Affiliate Account Information - We process personal information such as first and last name, date of birth, name of the legal entity and its legal representative, address, phone number, email address, IP address, payment information (i.e. PayPal, Stripe account and/or bank account information, personal or TAX identification number etc.).

  • Personal Data Contained in Log Files - When an Affiliate visits our Site we may process information such as IP address, referral URL, exit URL, browser software, operating system, date/time and/or clickstream data.

  • Personal Data Collected Through Website Analytics Tools - We may collect information about Affiliate’s use of our Site, such as number of visits, pages visited, popularity of certain content. Analytics tools use tracking technologies (such as cookies) to recognise the device used and compile the information. They collect information such as what pages the Affiliate visits and how much time the Affiliate spends on these pages, the IP address assigned to the Affiliate, what operating system and web browser the Affiliate uses, and what site the Affiliate visited prior to visiting our Site.

  • Other Types of Personal Data - We may process our communication with the Affiliate, as well as any personal information about the Affiliate which is made publicly available (e.g. in the social media accounts and channels of the Affiliate). We will also process any personal information voluntarily provided by the Affiliate to us. When the Affiliate contacts us, including via any of our support channels, we may process the personal data provided to us in order to deal with the Affiliate’s query. In addition, if the Affiliate loses access to its account, we may request certain documents in order to verify its identity. Those documents may contain personal data such as name, address, nationality, date of birth, identification document number etc.

Participants in Events/Promotions

  • a. Definition: Individuals who participate in raffles, surveys, campaigns and/or register to attend events, webinars and other promotions (co)organised and/or sponsored by us or any of the companies part of SCALIBIT.

  • b. Types of Personal Data Processed:

  • Contact Information - We may process Participant’s data such as first and last name, email address, address, phone number, social media username, etc.

  • Other Types of Personal Data - We may process your image and voice, if the event/promotion is being recorded. In case the promotions take place on our Site, when you visit it we may process information such as your IP address, referral URL, exit URL, browser software, operating system, date/time and/or clickstream data. We may also collect information about your use of our Site, such as number of visits, pages visited, popularity of certain content. Analytics tools use tracking technologies (such as cookies) to recognise your device and compile information about you. They collect information such as what pages you visit and how much time you spend on these pages, the IP address assigned to you, what operating system and web browser you use, and what site you visited prior to visiting our Site.

Other Individuals

  • a. Definition: Individuals who may not fall under the scope of the definitions listed above, such as potential customers, potential affiliates, third parties, part of account ownership disputes, complainants, inquirers, followers in our social media channels, etc.

  • b. Types of Personal Data Processed:

  • Contact Information - We may process information such as first and last name, name of the legal entity and its legal representative, email address, address, phone number, social media username, etc.

  • Other Types of Personal Data - We may process our communication with you, including your voice, if you contact us by phone, and/or your image, in case you share such data with us. We may also process personal information which is made publicly available (e.g. in social media or on other webpages) or any other types of personal data provided to us in order to deal with your query.

SCALIBIT processes personal data strictly in accordance with the principles of lawfulness, fairness, transparency, data minimization, accuracy, storage limitation, integrity, and confidentiality as defined under GDPR Article 5 and KVKK Article 4. Unless otherwise specified, all data categories listed above are processed solely for the purposes outlined in Section 4 (“Purposes of and Legal Basis for Data Processing”).

3. TYPES OF INFORMATION WE COLLECT AND HOW WE USE THEM

Some of the information we collect through or in connection with the Services is known as personal data (as defined under applicable data protection laws, such as GDPR and KVKK), which generally means information that identifies an individual and other information we associate with it. We may collect such information about you directly from you, from third parties, or automatically through your use of our Services. These categories are described in more detail below.

(A) Information You Provide

In order to access or use certain portions or functionality of the Services, or otherwise in conducting business with us or seeking to conduct business with us, you may be prompted to provide certain personal data to us in the following ways:

  • Persons who subscribe to our Services will be prompted to provide their name, physical address, e-mail address, phone number, and necessary billing information. Within a registered Account (defined in the Terms), you may also provide additional profile information, user preferences, notification preferences, and other such information.

  • You may provide personal data when filling in forms (for example, a “Contact Us” form), completing voluntary surveys, or otherwise interacting with us through online or offline communications. Persons who sign up for newsletters or other communications regarding our Services will be prompted to provide their e-mail address.

  • Prospective and current suppliers and subscribers, at a trade show or anywhere else we conduct business, when downloading documentation from our Services, by corresponding with us by phone, e-mail or otherwise providing contact details, or engaging in any business transaction with us. In these cases, typically, the personal data you provide may include name, business affiliation and job function, business contact information (physical address, phone number, email address), and any other personal details required for legal/compliance purposes or to resolve any inquiries or complaints. This personal data is required to enter into a contract with you (such as in anticipation of a supply agreement, or to learn about our Services) or to perform a contract with you (such as to provide Services), and failure to provide any information may result in our inability to provide requested Services or products.

In certain cases, SCALIBIT may request identity verification or supporting documentation (such as a government-issued ID, passport, business registration certificate, tax identification, or other relevant proof) to confirm account ownership, prevent fraud or abuse, ensure compliance with applicable laws (including but not limited to anti-abuse, anti-fraud, anti-money-laundering, and security verification requirements), or verify the legitimacy of a transaction or service request. This verification is performed only through secure and official SCALIBIT channels, such as your Client Portal or the authorized support ticket system. Such information is processed solely for verification purposes, stored securely, and may be retained as required by law or for legitimate business purposes, including cooperation with law enforcement authorities or compliance regulators when necessary. This information will never be used for profiling, marketing, or any unrelated activities.

(B) Information We Collect Automatically

We may use cookies to collect some of the information set out in this Privacy Notice. Cookies can store your account identifier, ordering status, personalization, or website tracking. They can also be used for technical purposes such as keeping track of your current shopping session and enabling you to proceed to checkout and pay for your order, or to save information which has already been entered (such as language preferences and your region), so that we can offer improved and more personalized Services, products, and other relevant communication tailored to you. Cookies also allow us to fulfil our contractual obligations to third parties and partners if you have made a purchase on our Site by following a link from theirs.

We also use remarketing pixels provided by third parties to collect information indicating that you have visited our Site and were interested in certain offers.

We also use beacons, tags, click tracking codes, and scripts to analyze trends and movements of users around the Site, gather information about the user base as a whole and how we can improve the Services and Site, to provide advertising based upon activities and interests, and to measure advertising effectiveness. As a result, we may display targeted or interest-based offers to you based on the products you currently own or have recently viewed, and deliver other communication more relevant to you and your interests outside of our Site, on other websites that are part of a third party's network.

We may share a unique code (such as a hashed email address) with advertising platforms and social networks to allow us to track online conversions from different sources and to direct targeted advertising to you or to a custom audience who share similar traits.

When you use our Services, our servers and software tools we use may automatically collect certain browser- or device-related information, including but not limited to: your domain, IP address, device identifier, date/time and duration of your visit, browser type, operating system, page visits, information referred to us from third parties, other technical information about your computer or device, and internet traffic activity.

In some cases this information constitutes personal data under applicable privacy laws, although we do not use this information to try to identify you by name, and we do not associate it with the information you provide voluntarily, as detailed below.

In general, we and our third-party service providers use cookies and other tracking mechanisms, including those designed for mobile applications, to track information about your use of our Services. In some instances, we may combine this information with other personal data we collect from you (and our third-party service providers may do so on our behalf). Additional information about such technology and how we use it is provided below:

(C) Information From Other Sources

Apart from you being the main source of information we collect about you, we may also collect information from publicly accessible sources (e.g., companies trade registers, WHOIS, local or national lists of sanctioned persons, social media, and other webpages) and/or from third parties such as our affiliates and trusted partners, including but not limited to marketing, advertising, and security service providers.

We may also receive information about you from third-party sources, such as fraud and risk scoring services from businesses like MaxMind and Kount. We may also obtain information from social media platforms that individuals use to engage with us. We only collect such information when it is necessary to verify identity, prevent fraud, comply with legal obligations, or maintain the security and integrity of our Services.

4. PURPOSES OF AND LEGAL BASIS FOR DATA PROCESSING

How We Use Your Information

We may use your personal data as permitted or required by law for the following purposes.

We strive to collect only the minimum personal data necessary for the completion of the purposes of data processing, as set out below.

If you are residing in a country governed by data protection or privacy laws (including but not limited to the United States, Canada, the European Union/EEA, the United Kingdom, or Türkiye), the following purposes and legal bases shall be applicable to the processing of your personal data by SCALIBIT:

  • To provide our Services to you, to communicate with you about your use of our Services, to respond to your inquiries, to fulfill transactions, provide you with documentation or communications you requested and for other customer service purposes (e.g., sales, technical or billing support, or responding to queries or complaints).

  • To provide, administer, maintain and secure the Services (including our network, information systems and the server functionality operated by us) and fulfill our obligations under the applicable agreements and terms, including to administer any promotions (co)organised and/or sponsored by us or any of the companies part of SCALIBIT. In such cases the legal basis for the data processing is the performance of a contract and compliance with a legal obligation.

  • To maintain and secure our Site, network, information systems and the server functionality operated by us, including but not limited to investigating and preventing fraudulent transactions, unauthorised access to the Services and other illegal activities, to address any queries, to enforce our terms, to defend against claims and protect the rights, property or safety of SCALIBIT, to notify you for any Service-related matters, to invite you (via separate email or during our interaction with you via any of our communication channels) to give your feedback and/or review regarding the quality of our Services and/or your experience with us and our interaction, to improve and/or develop the Services for the benefit of our Customers, and for statistical purposes. In such cases the legal basis for the data processing is our legitimate interest.

  • To tailor the content and information that we may send or display to you, such as displaying information on your use of our cloud services, to offer location customization, and personalized help and instructions, and to otherwise personalize your experiences while using the Services.

  • To administer and manage performance of purchase or sales agreements with our suppliers and customers.

  • To operate the Services including to evaluate, maintain, monitor performance, troubleshoot, improve and develop the Services (including by monitoring and analyzing trends, access to, and use of the Services to engage in advertising and marketing activities).

  • To promote our brand and Services, including to send marketing communications, newsletters, and surveys, monitor and analyze activities for advertising purposes, etc. In such cases the legal basis for the data processing is your consent. The consent to such marketing communication is voluntary and can be revoked at any time. The revocation can take place in the settings in the Customer account or via the unsubscribe link in every such marketing email sent by us.

  • To better understand how users access and use our Services, both on an aggregated and individualized basis, in order to improve our Services and respond to user desires and preferences, and for other research and analytical purposes.

  • To protect and ensure the quality, security, integrity and safety of the Services, our business operations, and our confidential and proprietary technology and information.

  • To fulfil our legal obligations, such as compliance with court orders, orders/requests or other documents issued by competent authorities, applicable legislation, etc. In such cases the legal basis for the data processing is the compliance with a legal obligation to which we are subject.

  • To verify your identity, confirm account ownership, prevent fraud or abuse, and ensure compliance with applicable laws (including but not limited to anti-abuse, anti-fraud, anti-money laundering, and security verification requirements). In certain cases, SCALIBIT may request identity verification or supporting documentation (such as a government-issued ID, business registration certificate, tax identification, or other relevant proof) to validate account authenticity, verify the legitimacy of a transaction, or comply with lawful requests. Such data is processed only when necessary, securely stored, and may be retained as required by law or for legitimate interests such as ensuring network and service security.

  • To prevent, detect, investigate, and address actual or suspected fraud, violation of law or our Terms, claims and other liabilities, or any threat of physical or financial harm to us, our staff or any other individuals or entities.

  • As may be otherwise disclosed at the time of collection.

  • For other purposes which may not fall under the scope of the above-mentioned purposes we will obtain your consent.

If you are residing in a country governed by privacy laws under which consent is the only or most appropriate legal basis for processing personal data, your acceptance of this Privacy Notice or your use of our Site and/or Services, or your communication with us (as the case may be) will be considered your consent to the processing of your personal data for the purposes detailed herein.

We process personal data with your consent or to fulfill our contract with you, based on our legitimate interest, or other lawful bases. The specific basis of processing depends on the services you are using, the data being processed, the place where the processing occurs, and the place where you live. We also use non-personal or de-identified data, such as that collected automatically or aggregated from our data sources, for research and development activities, analytics purposes, or for marketing and other purposes. Such de-identified data cannot reasonably be used to identify an individual and is therefore not subject to this Notice.

5. OTHER PROCESSING ACTIVITIES

In addition to the specific purposes for which we may process your Personal Data set out above, we may also process any of your Personal Data where such processing is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

This may include responding to lawful requests from competent authorities, law enforcement agencies, or courts where required by applicable law. In such cases, any disclosure of data will be limited to what is strictly necessary to comply with the official and verifiable request, in accordance with this Privacy Notice and applicable data protection laws.

Please do not supply any other person's Personal Data to us, unless we ask you to do so. If you provide Personal Data about another individual (such as a co-admin, contact person, or payment representative), you confirm that you have the necessary authorization to share such data and that the individual has been informed of this Privacy Notice.

6. NOTICE REGARDING USE OF OUR COMMUNITY FORUM AND INTERNAL MESSAGING

Any personal data provided in portions of a user profile, member directory, or other related Services that you set as public is directed to the public and should be deemed generally available to the public. We do not, cannot, and will not act to maintain the privacy of any personal data that you provide publicly in any such forum or medium.

Likewise, any internal messaging or community forum we make available for Users (such as for discussions regarding the Services) should not be considered secure or confidential and any personal data you directly share in such a forum is not considered private information. You must use caution when sending any personal data through such forums, and not transmit anything you do not want disclosed to the general public.

7. HOW WE DISCLOSE YOUR INFORMATION

Sharing of Personal Data

We disclose entire or part of your personal data in the following circumstances and always ensure that appropriate safeguards on your privacy are undertaken.

We may share your information, including personal information, as follows:

  • We may share your personal data with service providers that we believe need the information to perform a technology, business, or other professional function for us (examples include providers of IT infrastructure, payment processing, fraud detection, marketing and analytics services, professional services such as accounting or legal counsel, and other companies that work with us to improve or provide our Services). We only provide such data so they can perform their required functions on our behalf, and our agreements generally obligate them to comply with applicable privacy laws, keep the data safe and secure, and not use the data except for purposes provided. If you have an independent relationship with any such third party service provider, their use of your data may be governed by their independent relationship with you, and we are not responsible for such use.

  • To provide the Services and run our business – We may engage third-party service providers in the delivery of the Services and also for administrative, billing, tax, compliance and all other purposes related to the management of your account and our operations. In such cases your personal data may be shared with companies part of SCALIBIT, business partners, independent contractors, intermediaries, external consultants, auditors, collaborators, etc. Those third-party service providers include companies that operate in different industries such as fraud detection, technology service, internet information providers, payments and data processors, couriers, providers from the finance, media and communication, internet content and information industries, advertising and marketing, technologies, analytics, etc. and that may be located worldwide (including but not limited to the EU, EEA, Switzerland, UK, USA, Canada, Türkiye, Australia, Singapore, etc.).

  • We partner with reputable payment processors to handle financial transactions securely. Below are detailed sections for each payment processor:

    - PayPal: We may share personal data with our payment partner PayPal, which acts as an independent controller for processing the shared personal data. The processing of personal data by PayPal is governed by its privacy statement at https://www.paypal.com/us/webapps/mpp/ua/privacy-full

    - Stripe: We may share personal data with our payment partner Stripe, which acts as an independent controller for processing the shared personal data. The processing of personal data by Stripe is governed by its privacy statement at https://stripe.com/privacy.

  • We also may share data with Google whose invisible reCaptcha service we use to protect our website from malicious activity. Use of the invisible reCaptcha is subject to Google’s Privacy Policy and Terms of Service.

  • We may use artificial intelligence (AI) models and tools and integrate them into our Services for various purposes (such as SCALIBIT search tools, text and visual content generation, customer support, including but not limited to quality evaluation and improvement, etc.). We will disclose any such use on the respective webpage where the AI models and tools are integrated. In the course of using these AI models and tools, we will not disclose any personal data to the third-party providers. Although we take all necessary and reasonable care to obfuscate or anonymize any personal data before sharing information, we strongly advise you not to include any personal data in the AI tools integrated into our Services.

  • To resell products and/or services of our contractors and comply with their applicable rules, regulations, and policies – When we act as resellers of products and/or services of our contractors (e.g., domain name registrars, SSL certificate providers, etc.), we may share your personal information contained in the respective order for the purchase of the products/services with these contractors to provide the respective services or products. The contractors further process the personal data shared following their privacy policies and practices.

  • We may share your data among our legal affiliates so they can support aspects of our Services or engage more broadly with those who may be interested in other products or services.

  • To comply with the applicable legislation and to exercise rights – We may share personal data with companies, organisations or individuals when we believe in good faith that access, use, preservation or disclosure of such data is necessary to meet any applicable law, comply with regulations, legal procedures, enforceable requests and/or competent authority requirements; to enforce our Terms, defend against claims, and protect the rights, property or safety of SCALIBIT, our Customers and/or the public as required and/or permitted by law.

    DISCLOSURE TO AUTHORITIES AND LEGAL REQUESTS

    SCALIBIT may disclose Customer Data, Service Details, account information, or associated IP address data to competent authorities or legally authorized bodies — including but not limited to law enforcement agencies, prosecutor’s offices, courts, or data protection regulators — when such disclosure is required to comply with applicable laws, regulations, or enforceable legal requests. All disclosures are handled strictly within the scope of the law, upon receipt of an official and verifiable request, and limited to the minimum necessary information to fulfill the legal obligation. SCALIBIT carefully reviews each request to ensure that it is lawful, proportionate, and specific in scope.

    Unless prohibited by law or court order, SCALIBIT will make reasonable efforts to notify the affected Customer prior to any disclosure, particularly where the Customer’s data or account may be directly impacted by such request. We maintain detailed records of such disclosures to ensure transparency and accountability in accordance with applicable privacy legislation.

  • To comply with any laws, regulations, or valid governmental or legal demands for such data, including in response to any criminal, civil, or administrative process, discovery request, subpoena, court order, writ, or other demand by authorities.

  • To protect ourselves, our business partners, and customers, or the general public. For example, we may, where appropriate or required, disclose personal data to law enforcement in the event of a suspected or confirmed crime.

  • In connection with the potential or actual sale of our company or any of our assets, or those of any affiliated company, in which case personal data held by us about our users may be one of the transferred assets.

  • To the extent permitted by law and as described herein, we may share limited identifying information with advertising and analytics partners, subject to any required consents and respecting any required opt-in or opt-out rights provided by applicable laws.

  • To comply with your instructions – We may share your information with third parties with your explicit consent or at your direction. We will not, however, sell, rent, share or otherwise disclose personal data for commercial purposes in any way that is contrary to the commitments made in this Privacy Notice.

  • We may also use the services of third-party service providers for reviews (such as Trustpilot, etc.) to collect your feedback and/or review regarding our Services, their performance, our overall service quality and/or your experience with us and our interaction. In this case your name, email, chat or ticket ID, or other reference data will be shared with such third-party service providers, and they will process your data under their own privacy policies and practices.

  • If we are under a duty to disclose or share your Personal Data in order to comply with any legal obligation, or in order to enforce or apply our Terms of Service and other agreements; or to protect the rights, property, or safety of SCALIBIT, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

  • We will also share your information to the extent necessary to comply with ICANN or any ccTLD rules, regulations and policies when you register a domain name with us.

LAWFUL REQUESTS & COOPERATION WITH AUTHORITIES

SCALIBIT may receive formal and verifiable requests for information from authorized public institutions, law enforcement bodies, or judicial authorities — including but not limited to Police, Prosecutor’s Offices, Courts, and Cybercrime Units. Such requests may relate to the identification of Customers, IP address allocations or routing information, account or payment records, or other service-related data. SCALIBIT carefully reviews each request to confirm its legality, jurisdiction, and proportionality before disclosing any data.

Where disclosure is required by law, SCALIBIT may provide limited and relevant information — such as customer identification data, service configuration details, IP address allocation, routing, and usage logs, or, when lawfully requested, server or system image copies. All such disclosures are performed strictly within the limits of applicable data-protection and privacy laws, including the GDPR, CCPA, and KVKK, and only to the extent necessary to comply with a lawful obligation.

In cases involving cybercrime, fraud, abuse, or illegal network activity, SCALIBIT may immediately suspend or null-route affected IP space or services without refund to protect network integrity and comply with regulatory or judicial orders. This includes both Customer-owned IP space announced through SCALIBIT’s network and SCALIBIT-owned IP addresses leased to third parties.

SCALIBIT maintains detailed internal audit logs of all disclosure and enforcement actions for accountability and transparency. Where legally permissible, we may notify affected Customers once the disclosure has occurred or when the restriction on notice is lifted.

All cooperation under this section is conducted in good faith, strictly for the purpose of legal compliance and the protection of SCALIBIT’s infrastructure, and in accordance with our Data Processing Agreement and applicable privacy regulations.

We engage with a range of trusted third-party contractors and suppliers who provide services to us in the context of any of the purposes described above or elsewhere in this Privacy Notice. Whenever we engage with third-party service providers, we undertake appropriate due diligence and impose contractual obligations to ensure that any personal data shared with them is appropriately protected (including in the context of any international transfer of data) and only used for the purpose of providing services to us.

Where appropriate, we will limit sharing of your personal data in accordance with the choices you have provided us and applicable law.

8. DOMAIN REGISTRATION DATA IN THE PUBLIC WHOIS

To register a domain name, you must provide certain personal information including:

  • Contact Information: Your name, address, phone number, and email address.

  • Identity Verification: Some registries may also require you to provide additional documentation to verify your identity, such as a government-issued ID, passport, or business registration document.

  • Additional Contact Point: Some registries may require one or more additional contact points (e.g., administrative or technical contacts) to be listed for the domain registration.

Your Personal Data will be used for the following purposes:

  • Verifying your identity and contact information.

  • Billing and invoicing for the domain registration.

  • Providing customer support and assistance.

  • Communicating important information about the domain registration, management, and renewal.

The domain Registrar, as the entity responsible for managing the registration of domain names, collects and stores your Personal Data in accordance with applicable laws and regulations. The Registrar may share this data with other Registrars, Resellers, or Registries as required to process and manage your domain registration. The domain Registry, as the entity maintaining the database of registered domain names, will also receive your Personal Data for the purposes of maintaining accurate records, ensuring compliance with relevant policies, and fulfilling technical or regulatory requirements.

Both the Registrar and the Registry may be required to share your Personal Data with ICANN (Internet Corporation for Assigned Names and Numbers) or relevant supervisory authorities as part of their policy and compliance obligations. In certain cases, this may also include limited publication of contact information in the public WHOIS database unless privacy or redaction services have been applied.

Details of the Registry responsible for each domain extension (TLD) can be found in the official Root Zone Database maintained by IANA (Internet Assigned Numbers Authority).

The Root Zone Database lists the delegation details of top-level domains (TLDs), classified as either generic (e.g., “.com”) or country-code TLDs (e.g., “.uk”, “.de”, “.nl”, “.tr”). The Registry or Registrar with which we contract to register the domain may publish your registration details in the public WHOIS directory, unless you have purchased or enabled Domain (WHOIS) Privacy or ID Protection services. When privacy protection is active, your personal contact details are replaced with proxy or anonymized contact information in accordance with applicable ICANN and Registry policies.

9. COMMUNICATIONS FROM SCALIBIT

  • Welcome Emails and General Correspondence. We send a welcoming email to the address associated with a new account to verify the user’s identity and confirm the successful creation of their SCALIBIT account. This verification process prevents unauthorized use of email addresses. Established users may occasionally receive information about products, services, updates, special offers, and newsletters. Out of respect for user privacy, we provide the option to opt out of non-essential marketing communications. Please see the opt-out options below.

  • Service and Operational Communications. We send mandatory service-related announcements that include important information about your account, service status, billing, scheduled maintenance, or policy changes. These operational messages may include but are not limited to: account verification notices, service suspension or abuse alerts, billing and payment reminders, fraud or security notifications, IP block or quota warnings, and network or infrastructure updates. Because these communications are essential for the proper operation of your account and the fulfillment of our contractual obligations, users cannot opt out of receiving them.

  • Billing and Payment Notices. SCALIBIT may send invoices, renewal reminders, payment confirmations, and related account balance updates by email or through the client area. These notifications are automatically generated and form part of the billing and financial management process between you and SCALIBIT.

  • Abuse, Security, and Compliance Notifications. We may contact customers to investigate, mitigate, or notify about suspected policy violations, abuse reports, security threats, spam complaints, or other compliance-related matters. Such notifications are strictly limited to ensuring service integrity, protecting network stability, and complying with applicable law. These messages are considered mandatory system alerts and cannot be unsubscribed from.

  • Support and Ticket Responses. When you contact our support or abuse department, we will reply using the email address or client portal associated with your account. These communications are limited to resolving your request or inquiry and are not used for marketing purposes.

  • Surveys and Feedback. From time to time, we may invite you to participate in voluntary surveys or feedback programs to help improve our services. Participation is completely optional. Survey invitations may request non-sensitive information such as your general experience, satisfaction level, or service quality feedback.

  • Contests and Promotions. Occasionally, we may offer contests, giveaways, or promotional campaigns. Participation is voluntary, and you may choose whether to disclose personal information such as your name, contact details, or shipping address for prize fulfillment.

10. MARKETING COMMUNICATIONS

Where lawful to do so, and subject to your consent where required, we may contact you by email or other electronic means to inform you about SCALIBIT products, services, updates, promotions, or events that may be of interest to you.

If you prefer not to receive such marketing communications, you may opt out at any time by clicking the “unsubscribe” link provided in our emails, or by contacting us via our Contact Form. Opting out will stop future promotional messages, but will not affect service-related, transactional, or legally required notifications (such as billing updates, security alerts, or policy notices).

If you are an existing subscriber or account holder, we may occasionally send you information about new features, product enhancements, or relevant announcements related to your active services. You may manage your marketing preferences at any time using the unsubscribe options provided in those messages.

11. DATA PROCESSİNG AND TRANSFERS

When you use or interact with any of our Services, you consent to the processing, sharing, transferring, and use of your information as outlined in this Privacy Notice. Such processing will only occur when necessary for the performance of our contract with you, when we have your consent to do so, or subject to appropriate safeguards and standard contractual clauses. Regardless of the country where you reside, you acknowledge that your data may be transferred to and processed by SCALIBIT in multiple data center regions worldwide, including but not limited to the European Union, the United States, Asia-Pacific, and other operational locations. You authorize SCALIBIT to transfer, process, store, and use your information in these regions in accordance with this Privacy Notice and applicable data protection laws. Some of these countries or regions may not provide the same level of data protection as the country where you reside; however, SCALIBIT ensures that adequate safeguards and legal mechanisms are in place for all such transfers. By using our Services, you consent to these international data transfers and processing activities.

Compliance with legal, regulatory and law enforcement requests. We cooperate with government and law enforcement officials to enforce and comply with the law (see also Section 7 – “Disclosure to Authorities and Legal Requests”). We may disclose any information about you to government or law enforcement officials as we, in our sole discretion, believe necessary or appropriate to respond to legal process (such as subpoena requests), or to prevent or stop activity we consider to be illegal or unethical.

13. TÜRKİYE-SPECIFIC PRIVACY RIGHTS (KVKK)

SCALIBIT.COM – INFORMATION REGARDING THE LAW ON THE PROTECTION OF PERSONAL DATA (KVKK)

At SCALIBIT, we prioritize the confidentiality and security of your personal data. This section explains how we process personal data in compliance with Türkiye’s Law No. 6698 on the Protection of Personal Data (KVKK), which safeguards individuals’ rights to privacy and data protection.

SCALIBIT acts as a Data Controller only for customer account, billing, authentication, and communication-related information collected during registration and service use. For customer-managed environments, including but not limited to Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute Services (Standard Performance, High Performance, High Frequency), Optimized Cloud Compute Services (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), and Dedicated Servers (Dedicated Servers or Bare Metal), SCALIBIT acts solely as an infrastructure provider and does not access, review, or process customer-stored data. Customers retain full control over the operating systems, data, and configurations of their servers.

(A) Legitimate Bases for Processing

As Data Controller (Veri Sorumlusu), SCALIBIT processes personal data for the following purposes, in accordance with the KVKK and other applicable legislation:

  • Negotiating, concluding, and executing contracts.

  • Presenting, promoting, and providing products and services.

  • Customizing, upgrading, and improving products and services in line with customer needs and technical developments.

  • Identifying users within the system based on the products and services provided.

  • Providing call center and remote support services, including monitoring call numbers and contents for quality assurance and legal compliance.

  • Managing communication with customers, resellers, partners, and stakeholders for marketing and operational purposes.

  • Conducting market research, generating statistics, and analyzing service usage.

  • Processing payments, collections, and billing of products, services, and maintenance fees.

  • Managing supplier, partner, and business relationships, including reporting and contract administration.

  • Responding to public authority requests, legal proceedings, and administrative or judicial requirements.

  • Enforcing our Terms of Service, Anti-Spam Policy, and Acceptable Use Policy (AUP).

  • Ensuring the safety, security, and integrity of SCALIBIT’s infrastructure, employees, and proprietary information.

  • Detecting, preventing, and investigating potential fraud, security breaches, or violations of contract or law.

  • Managing investor relations, corporate strategy, and reporting obligations.

  • Fulfilling our legal obligations, including compliance with court orders or official authority requests.

  • Processing employee and job applicant data for hiring, training, payroll, and performance evaluation purposes.

  • Conducting visitor registration, security camera monitoring, and workplace safety measures.

  • Creating and maintaining personal data inventory records as required by law.

  • Handling all requests, inquiries, or complaints related to the processing of personal data in accordance with Article 11 of the KVKK.

(B) Method and Legal Grounds for Collection of Personal Data

SCALIBIT may collect personal data in writing, orally, or electronically through our website, support systems, social media channels, email communications, events, or business meetings. Data collection may occur via: (i) our website, email, and digital platforms (including recruitment portals); (ii) contracts, forms, call centers, remote support, and sales/marketing activities; (iii) in-person meetings and interviews. Your personal data may also be processed under the lawful bases outlined in Articles 5 and 6 of the KVKK.

(C) Disclosure of Personal Information

We may disclose personal data as permitted or required by law, including:

  • To comply with any applicable laws, regulations, or official authority requests.

  • To enforce our Terms of Service or investigate potential violations.

  • To cooperate with law enforcement or public authorities during criminal, civil, or administrative processes.

  • To protect our users, operations, and the general public from fraud, security threats, or legal risks.

  • In connection with mergers, acquisitions, restructuring, or similar corporate transactions.

(D) Transfer of Personal Data

Your personal data may be transferred to the following parties, in compliance with the KVKK and other applicable legislation:

  • Authorized representatives, business partners, suppliers, and contractors for operational purposes.

  • Regulatory, supervisory, and public authorities, when legally required.

  • Third-party consultants, including legal, financial, and tax advisors, both domestic and international, as permitted by law.

Personal data may also be transferred abroad when necessary for service delivery, technical support, or infrastructure operations, in accordance with Article 9 of the KVKK and applicable safeguards ensuring adequate protection.

(E) Exercising Your Privacy Rights

Under Article 11 of the KVKK, you, as the personal data owner, have the right to:

  • Learn whether your personal data is being processed.

  • Request information about the processing activities.

  • Learn the purpose of processing and whether data is used accordingly.

  • Know the third parties to whom data has been disclosed, domestically or abroad.

  • Request correction of incomplete or inaccurate data.

  • Request deletion or destruction of personal data when the reasons for processing no longer apply.

  • Object to decisions made solely through automated processing that may negatively affect you.

  • Request compensation for damages arising from unlawful processing of your data.

For data-related requests, SCALIBIT may require identity verification to confirm account ownership and ensure compliance with KVKK. All verification data is used solely for confirmation and securely deleted after processing.

SCALIBIT does not engage in profiling that produces legal or similarly significant effects on individuals and does not collect or disclose sensitive personal data (e.g., government ID, precise geolocation, or financial credentials) except as required for lawful purposes.

(B) California Residents

  • Financial Incentives. SCALIBIT does not provide financial incentives or loyalty programs in exchange for personal data. In rare cases, we may offer limited-time promotions or discounts that involve data collection; any such programs will disclose full terms at the time of participation.

  • Privacy Rights for Non-Customers. California privacy rights extend to all individuals, including job applicants, employees, contractors, and business partners. All such individuals can request access, correction, deletion, or disclosure details as described above by emailing privacy@scalibit.com. Verification may be required before processing requests.

  • Direct Marketing. SCALIBIT does not share customer contact details with third parties for their own direct marketing purposes.

  • California Minors. Our Services are intended for general audiences and are not directed toward minors. If a California resident under 18 has posted information on a public-facing forum provided by SCALIBIT, they may contact us to request removal or anonymization of such content, consistent with California law.

(C) Nevada Residents

SCALIBIT does not sell personal data as defined by Nevada Revised Statutes (Chapter 603A, Section 1.6). However, Nevada residents may submit a request or inquiry regarding the sale of personal data at privacy@scalibit.com.

16. COMPLIANCE WITH THE EU GENERAL DATA PROTECTION REGULATION (GDPR)

In accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”), which superseded Directive 95/46/EC, SCALIBIT implements all appropriate technical and organizational measures required by applicable data protection laws to safeguard personal data that we store, operate, or process on behalf of our clients.

16.1. Storage and Protection of Personal Information

Personal data collected through SCALIBIT Services may be stored or processed in Türkiye, the United States, or any other country in which SCALIBIT operates. SCALIBIT ensures that all cross-border transfers comply with applicable data protection requirements. We rely on Standard Contractual Clauses (SCCs) and equivalent safeguards to protect personal data when transferred internationally. SCALIBIT does not transfer personal data to jurisdictions that fail to provide an adequate level of protection as required by the GDPR.

All data is hosted on servers owned or managed by SCALIBIT in secure data centers meeting high physical and logical security standards. Safeguards include, but are not limited to:

  • a) Data centers with strict physical access control, 24/7 on-site personnel, and continuous video surveillance.

  • b) Servers protected by authentication mechanisms and layered security controls to prevent unauthorized access.

  • c) All SCALIBIT employees with access to personal data are bound by confidentiality and non-disclosure obligations.

  • d) Sensitive information transmitted through our systems (e.g., passwords, login data) is encrypted using Secure Socket Layer (SSL/TLS). However, no method of transmission or storage is completely secure; therefore, absolute security cannot be guaranteed.   • e) SCALIBIT complies with the GDPR with respect to the collection, use, and retention of personal data for all clients and data subjects located in the European Economic Area (EEA).

  • g) We respect your privacy rights and ensure reasonable access to your personal data. Upon request, we will delete or anonymize any personal references in our active databases, unless retention is required for legal or operational purposes.

You may update, correct, or delete your account details at any time from your Client Area. Please note that while updates take effect promptly, certain data may be retained for purposes such as fraud prevention, compliance, and enforcing agreements where legitimate interest exists.

16.2. Data Retention and Limitation

  • h) SCALIBIT retains personal data only as long as necessary for the purposes for which it was collected or as required by law. When the account becomes inactive or the data is no longer needed, it will be securely deleted or anonymized in accordance with SCALIBIT’s Data Retention Policy.

  • i) SCALIBIT does not own or control any “Client Data” stored or processed through its services. Such data belongs solely to the client, who determines its purpose and means of processing. SCALIBIT accesses such data only as authorized by the client or as necessary to provide the contracted services.

Because SCALIBIT does not determine the purposes or means of processing client data, it acts as a Data Processor under the GDPR, while the client remains the Data Controller. SCALIBIT’s responsibilities as a hosting provider fall under Article 14 of Directive 2000/31/EC (the E-Commerce Directive). The client, as Data Controller, is responsible for ensuring that the personal data stored or transmitted via SCALIBIT Services complies with the GDPR and other applicable laws.

SCALIBIT is not responsible for the content of client data or for how clients collect, manage, or process personal data through their own systems. Clients are solely accountable for compliance with data protection requirements regarding such data.

20. INTERNATIONAL DATA TRANSFERS

As a global web hosting provider, SCALIBIT operates through data centers and service partners in multiple countries. Therefore, your personal data may be transferred and processed outside your country of residence. All such transfers are conducted in full compliance with applicable data protection and privacy laws.

During the provision of our Services and business operations, we may transfer personal data to and from countries where SCALIBIT and/or our authorized partners maintain data centers or operational infrastructure. — Transfers between the United Kingdom (UK) and the EU/EEA

When transferring personal data between the UK and the EU/EEA, we rely on mutual adequacy decisions:

  • For transfers from the UK to the EU/EEA — we rely on the adequacy regulations adopted by the UK Government recognizing EU/EEA data protection as adequate.

In all cases, we ensure that adequate and proportionate technical and organizational security measures are in place to protect your personal data. We also perform transfer impact assessments (TIAs) and risk analyses where required by law to verify that cross-border transfers maintain an equivalent level of protection to that guaranteed within your jurisdiction.

21. SECURITY MEASURES

SCALIBIT implements industry-standard technical and organizational security measures designed to protect the confidentiality, integrity, and availability of personal data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. These measures are continuously reviewed and enhanced in line with technological developments and recognized security standards such as GDPR Article 32.

Our safeguards include a combination of technical, physical, logical, and procedural controls such as firewalls, intrusion-detection systems, encryption in transit and at rest, restricted access policies, and continuous monitoring of systems for vulnerabilities or suspicious activity.

When you enter sensitive information on our Site (such as login credentials or payment details), we use Secure Sockets Layer (SSL/TLS) encryption to protect data during transmission. Critical stored data is encrypted using industry-accepted algorithms and subject to strict access controls. Access to systems containing personal data is logged, monitored, and reviewed periodically to ensure compliance with internal security policies.

We comply with the Payment Card Industry Data Security Standard (PCI DSS) for all credit-card transactions processed through our payment partners. SCALIBIT does not store full credit-card numbers or CVV codes. All cardholder data is tokenized and managed securely by our PCI-certified payment processors.

To safeguard your account, we apply session management, multi-factor authentication (2FA), login-timeout mechanisms, and strong password policies. Authentication data is encrypted, and we recommend that you sign out of your account after use and keep your device secure.

While SCALIBIT employs reasonable and proportionate security measures to protect your information, no method of electronic transmission or storage is entirely secure. Accordingly, we cannot guarantee absolute security. In the unlikely event of a data-security incident involving your personal data, we will comply with all applicable data-breach notification requirements and provide legally required notices, which may be delivered via email or a prominent notice on our website or Client Area.

22. SERVER DATA

SCALIBIT provides infrastructure-based services — including but not limited to Shared Web Hosting (cPanel Hosting, CWPpro Hosting, WordPress Hosting), Domain Registration, SSL Certificates, Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute (Standard Performance, High Performance, High Frequency), Optimized Cloud Compute (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), and Dedicated Servers / Bare Metal.

In these contexts, SCALIBIT acts solely as an infrastructure provider, and in certain limited cases as a data processor (for example, in Shared Web Hosting environments), but never as a data controller of the information that customers choose to store, process, or transmit through our systems.

When customers use SCALIBIT infrastructure, they remain the data controllers for all information, files, or content stored or transmitted through our servers. Customers are fully responsible for determining the sensitivity, classification, and applicable security measures for their own data, including implementing appropriate safeguards, access controls, and encryption standards. SCALIBIT may provide optional tools, guidance, or technical assistance to help customers protect their data, but ultimate responsibility remains with the customer.

SCALIBIT does not access, monitor, or modify customer data hosted on its servers unless explicitly authorized by the customer or required by applicable law or court order. Any access that may occur (for example, for troubleshooting or maintenance) is logged, restricted to authorized personnel, and subject to confidentiality and data protection obligations.

SCALIBIT does not store or have access to customer passwords, private SSH keys, or server-side data. All authentication credentials are generated and managed directly by the customer within their hosting environment. SCALIBIT’s administrative access, where applicable, is strictly limited to system-level infrastructure operations and never extends to customer content.

Customers are encouraged to maintain their own data backups, apply strong password policies, and use secure connection methods (such as SSH, SFTP, or HTTPS) to further ensure data integrity and confidentiality within their hosted environments.

23. ACCOUNT SECURITY AND RESPONSIBILITIES

When you register for an Account or are provided with login credentials (such as a username, password, or API key) to access SCALIBIT Services, you are fully responsible for maintaining the confidentiality, integrity, and security of those credentials. You agree not to disclose or share your authentication information with any third party and to take reasonable steps to prevent unauthorized access to your Account.

If you believe your password or account information has been compromised, you must immediately change your password and notify us through our support channels at https://www.scalibit.com/contact-us/. SCALIBIT cannot and will not be liable for any loss or damage arising from your failure to maintain the confidentiality of your login information.

You are also responsible for all activity that occurs under your Account, whether performed by you, your employees, contractors, or any other individuals to whom you may have granted access (intentionally or otherwise). It is your responsibility to ensure that all authorized users comply with this Privacy Notice and all other applicable SCALIBIT policies.

We strongly recommend using strong, unique passwords and enabling two-factor authentication (2FA) where available. You should periodically update your passwords and ensure that login information is stored securely and never reused across multiple services.

Please be aware that keyloggers, malware, or other surveillance software installed on your device may intercept your login credentials. For your protection, you should use trusted, updated antivirus software and avoid logging into your account from shared or public computers. Always log out after completing your session and avoid saving passwords on browsers or untrusted devices.

SCALIBIT employs advanced security controls to protect user authentication processes, but users share responsibility in maintaining account security. Failure to adhere to these responsibilities may result in unauthorized access or account suspension for security reasons.

24. RETENTION OF PERSONAL DATA

We apply a general rule of keeping personal data only for as long as required to fulfill the purposes for which it was collected including (i) to provide you with our products and services, such as to maintain Account records while active and after termination for the purposes described above, and (ii) as reasonably as necessary for legal, tax and accounting requirements, or if required to do so by a legal process, legal authority, or other governmental entity having authority to make the request, for so long as required.

Since we need to comply with applicable regulations in regard to retention of personal information related to contractual agreements, provision of Services, financial, billing, invoicing operations, tax calculations etc., a versioned copy of your order, payment and billing documentation may be stored for a period of 10 years after the termination of your Customer account. Your personal data is deleted automatically by our systems in accordance with these retention periods.

With respect to marketing (absent other bases for collection or use), we endeavor to only retain personal data for 18 months after your last request for service or we engage in some other form of contact.

Please note that certain information may be retained for a longer period, even after a deletion request, where retention is required to comply with applicable laws, enforce our agreements, resolve disputes, or respond to lawful requests from public authorities. This includes requests from law enforcement, regulatory, or judicial authorities (e.g., police, prosecutor’s office, or courts) in accordance with applicable legal procedures. In such cases, SCALIBIT will retain or disclose data only to the extent necessary to comply with those legal obligations.

25. THIRD-PARTY LINKS

This Privacy Notice applies solely to personal data collected directly by SCALIBIT through our Services and in the course of our legitimate business operations. Our Services may include links, integrations, or references to third-party websites, social media platforms, or external services operated by entities not affiliated with SCALIBIT. 26. CHILDREN

Our Services are not directed to or intended for use by individuals under the age of 18 (or the age of majority in their jurisdiction, if higher). SCALIBIT does not knowingly collect, store, process, or use any personal data of individuals under 18 years of age as a data controller. If you are under 18, you may not register, access, or use our Services, nor provide any personal information to us.

In compliance with applicable child data protection regulations, including Article 8 of the EU General Data Protection Regulation (GDPR) and the U.S. Children’s Online Privacy Protection Act (COPPA), we take reasonable technical and organizational measures to prevent the collection of personal data from minors. If we become aware that we have inadvertently received or processed personal data from anyone under the age of 18, we will take immediate steps to delete such information from our systems.

27. JOB APPLICANTS AND OTHER NON-USERS

SCALIBIT may collect and process personal data from job applicants and other individuals who are not users of our Services, in connection with employment applications, recruitment, vendor relationships, or other business interactions. The information collected may include your name, contact details (such as email address, phone number, and physical address), professional experience, education details, and the contents of any submitted resume, CV, or cover letter.

We use this information solely for legitimate business purposes, including evaluating candidates for employment opportunities, conducting interviews, performing background and reference checks (where permitted by law), maintaining communication throughout the recruitment process, and complying with legal or regulatory obligations related to hiring and employment.

28. PERSONAL DATA MANAGED BY OUR CLIENTS

We use the term “Client” to describe a customer of SCALIBIT to whom we provide our Services under a contractual agreement (the “Service Agreement”). Our Clients may use SCALIBIT’s infrastructure and hosting platforms to store, transmit, or otherwise process data, which may include personal data relating to their own customers, users, or end-clients. We refer to this information as “Client Customer Data”.

SCALIBIT does not have a direct relationship with individuals whose personal data may be included in Client Customer Data. We act solely as a data processor (or sub-processor, as applicable) on behalf of our Clients, who act as the data controllers for any such personal data. Accordingly, Clients are solely responsible for determining the purpose and lawful basis for processing Client Customer Data and for ensuring compliance with applicable data protection and privacy laws.

We do not access, use, or disclose Client Customer Data except as authorized by the Client, or as required to provide the Services in accordance with the Service Agreement, or in limited circumstances where required by applicable law, regulation, or valid legal process (such as a court order or law enforcement request).

In accordance with Article 14 of the Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 (the “E-Commerce Directive”), SCALIBIT acts as a hosting provider and is not responsible for the content of the data hosted or transmitted by its Clients. SCALIBIT shall not be deemed a data controller within the meaning of the EU General Data Protection Regulation (GDPR) for Client Customer Data.

Clients are responsible for maintaining appropriate administrative, technical, and organizational safeguards, including data encryption prior to transmission, secure account credentials, and user access management, to ensure the security and confidentiality of Client Customer Data.

Any inquiries, requests, or complaints related to Client Customer Data — including access, correction, or deletion requests — should be directed to the respective Client (data controller). If SCALIBIT receives such a request directly, we will promptly forward it to the relevant Client without delay.

SCALIBIT is not responsible for the nature, accuracy, or lawfulness of Client Customer Data stored on its servers, nor for how such data is collected, handled, or processed by the Client.

29. LEGAL DISCLOSURE

SCALIBIT, its affiliates, and trusted service partners may disclose personal data when required to do so by applicable law, regulation, legal process, or enforceable governmental request. This includes, without limitation, responding to lawful requests from courts, law enforcement authorities, tax agencies, data protection regulators, or other competent public bodies.

We may also disclose information when necessary to protect our rights, property, and safety — as well as those of our users, clients, or the public — or to prevent fraud, abuse, security incidents, or other illegal activities.

In all cases, SCALIBIT will evaluate the legitimacy and scope of any legal or regulatory request before disclosing any information, and we will only provide the minimum amount of personal data necessary to comply with the relevant legal obligation.

Where legally permissible, we will notify the affected Client or individual before such disclosure so they may take appropriate steps to protect their interests. However, in cases where the law prohibits such notification (e.g., due to ongoing investigations or national security considerations), SCALIBIT may be required to comply without prior notice.

All such disclosures are made in good faith and in accordance with applicable data protection laws, including but not limited to the GDPR, CCPA, and KVKK. We do not sell, trade, or otherwise transfer your personal information to any third party for commercial purposes under the guise of legal disclosure.

30. CHANGES TO THIS NOTICE

SCALIBIT reserves the right to revise, update, or modify this Privacy Notice at any time to reflect changes in our practices, technologies, legal requirements, or industry standards. Any modifications will become effective immediately upon being posted on our official website at https://www.scalibit.com, unless otherwise stated.

Your continued use of our Services following the publication of any updated version of this Privacy Notice will constitute your acknowledgment and acceptance of the changes. We encourage all users to review this Privacy Notice periodically to remain informed about how we protect and handle your personal data.

Where legally required or if the changes materially affect your rights or obligations, SCALIBIT will provide notice of such updates via email or through your client area. It is your responsibility to ensure that your account information, including your email address, remains accurate and up to date so that we can reach you for important notices.

SCALIBIT shall not be liable for any failure of notice delivery due to outdated or inaccurate contact details provided by you. In the event of a material breach or violation of this Privacy Notice or the Service Agreement, SCALIBIT reserves the right to suspend or terminate services in accordance with our Terms of Service.
