US States Privacy Notice

US STATES PRIVACY NOTICE

This Privacy Notice applies to residents of the U.S. states of California (CCPA), Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia, and describes how SCALIBIT (“we,” “us,” “our,” etc.), our affiliates, and service providers collect, use, and disclose information. This Notice also provides you with information about your choices and rights regarding your personal information.

SCALIBIT is committed to protecting privacy and transparency for all U.S. residents. As additional state privacy laws come into effect, SCALIBIT will extend the same or equivalent protections to residents of those states and update this Notice accordingly.

SCALIBIT fully supports the CCPA, and all SCALIBIT Services comply with its provisions.

For managed environments (such as Shared Web Hosting: cPanel Hosting, CWPpro Hosting, WordPress Hosting) or temporary technical support cases where SCALIBIT personnel may require limited, purpose-bound access, SCALIBIT acts as a “service provider” under applicable U.S. state privacy laws (e.g., CCPA, CPA, VCDPA, CTDPA) and our Data Processing Addendum (DPA).

SCALIBIT acts as a “business” with respect to customer account, billing, and authentication data. We do not act as a Data Controller or a Data Processor for any data stored or transmitted on customer-managed or self-managed servers, including but not limited to Virtual Machines (VPS, VDS, Dedicated Cloud Servers), Cloud Services (Cloud Hosting, Cloud Servers, Cloud Backup), Cloud Compute (Standard Performance, High Performance, High Frequency), Optimized Cloud Compute (General Purpose, CPU Optimized, Memory Optimized, Storage Optimized), and Dedicated Servers or Bare Metal systems. Any support access, if requested, is strictly least-privilege, logged, and time-bound.

Definition of “Site” and “Services”

For the purposes of this Privacy Notice, the term “Site” refers to all SCALIBIT-owned and operated websites and subdomains (including but not limited to www.scalibit.com, client portals, control panels, and associated web interfaces) that are used to provide or manage SCALIBIT products and services.

The term “Services” collectively refers to all infrastructure-based hosting and internet services provided by SCALIBIT, including but not limited to the following categories:

• Shared Web Hosting: cPanel Hosting, CWPpro Hosting, and WordPress Hosting

• Virtual Machines: VPS, VDS, and Dedicated Cloud Servers

• Cloud Services: Cloud Hosting, Cloud Servers, and Cloud Backup

• Cloud Compute: Standard Performance, High Performance, and High Frequency

• Optimized Cloud Compute: General Purpose, CPU Optimized, Memory Optimized, and Storage Optimized

• Dedicated Servers: Enterprise-grade physical Dedicated Servers or Bare Metal configurations, available in multiple global locations

• Domain Name Products and Services: Domain registration, renewal, management, transfer, and related enhancements such as Domain Protection, Whois Privacy, and Premium DNS

• SSL Certificate Products and Services: Purchase, issuance, renewal, and management of SSL/TLS certificates

• IP Address Services: Assignment, routing, and management of IPv4 and IPv6 addresses provided with SCALIBIT Services — including Shared Web Hosting, Virtual Machines, Cloud Services, Cloud Compute, and Dedicated Servers or Bare Metal — as well as the direct leasing of dedicated IP address blocks

• Ancillary Add-ons and Beta Services: Additional, optional, or preview offerings associated with active SCALIBIT Services

Collectively, the above offerings and their corresponding websites, portals, and interfaces are referred to throughout this Notice as the “Site” and “Services.”

Information You Provide

In order to access or use certain portions of the Site or Services, or enjoy the full functionality of the Site or Services, or otherwise in conducting business with us or seeking to conduct business with us, you may be prompted to provide certain personal information to us in the following ways:

• Persons who subscribe to the Services will be prompted to provide their name, their address, their e-mail, their phone number, and any other necessary billing information.

• Persons who complete registration forms to sign up for membership on the Site will be prompted to provide their e-mail address.

• Site visitors, and prospective and current suppliers and subscribers, may provide personal information when filling in forms (for example, a “Contact us” form) on our Site or at a trade show or anywhere else we conduct business; by downloading documentation from our Site; by subscribing to newsletters or other communications; by corresponding with us by phone, e-mail or otherwise providing contact details. In these cases, typically, the personal information you give us may include name, business affiliation, business address, telephone number, and email address, and any personal details required to resolve any inquiries or complaints.

This personal information is required to enter into a contract with us (such as in anticipation of a supply agreement, or to learn about our Services) or to perform a contract with you (such as to provide Services), and failure to provide any information may result in our inability to provide requested Services or products.

Information We Collect Automatically

When you visit our Site or use the Services, information is passively or automatically collected by our web servers and by third party analytics tools we use, including but not limited to:

• Your domain,

• Your IP address,

• Your date, time and duration of your visit,

• Your browser type,

• Your operating system,

• Your page visits,

• Information from third parties,

• Other information about your computer or device,

• Internet traffic.

We do not use this automatically collected information to try to identify you by name, and we do not associate it with the information you provide voluntarily to us.

Information From Other Sources

We may also obtain fraud & risk scoring data about you from third parties, namely MaxMind and Kount.

Use of Personal Information

We may use your personal information as permitted or required by law, and for the following business purposes:

• Provide you with Services you have subscribed for, or otherwise requested,

• Provide you with documentation or communications which you have requested,

• Administer and manage performance of purchase or sales agreements with our suppliers and customers,

• Provide after-sales support,

• Correspond with users to resolve their queries or complaints,

• Market our services to persons whose Services have expired or otherwise been cancelled,

• Engage you about events, promotions, the Site, and SCALIBIT's products and services,

• Process, evaluate and complete certain transactions involving the Site, and more generally transactions involving the Services,

• Operate, evaluate, maintain, improve and develop the Site (including by monitoring and analyzing trends, access to, and use of the Site for advertising and marketing),

• To increase users' experience according to tracked interests, to analyze and target potential new markets, and for other marketing purposes,

We may also use personal information as we believe to be necessary or appropriate for certain essential purposes, including:

• To enforce our Terms of Service, Anti-Spam Policy, Use Policy or any other applicable policies,

• To protect our operations or those of our affiliates and ensure safety of the Site, SCALIBIT confidential and proprietary information, and SCALIBIT employees,

• To manage, protect against and investigate fraud, risk exposure, claims and other liabilities, including but not limited to violation of our contract terms or laws or regulations,

• To comply with applicable law and legal process, and to respond to requests from public and/or government authorities,

• If we are or may be acquired by or merged with another company, if any of our assets are transferred to another company, or as part of a bankruptcy proceeding.

We also use deidentified and/or aggregate information to customize our marketing efforts or to customize the use of our site for an aggregate group of customers.

In certain cases, SCALIBIT may request identity verification or supporting documentation (such as a government-issued ID, passport, business registration certificate, tax identification, or other relevant proof) to confirm account ownership, prevent fraud or abuse, ensure compliance with applicable laws (including but not limited to anti-abuse, anti-fraud, anti-money-laundering, and security verification requirements), or verify the legitimacy of a transaction or service request. This verification is performed only through secure and official SCALIBIT channels, such as your Client Portal or the authorized support ticket system. Such information is processed solely for verification purposes, stored securely, and may be retained as required by law or for legitimate business purposes, including cooperation with law enforcement authorities or compliance regulators when necessary. This information will never be used for profiling, marketing, or any unrelated activities.

Important Information for Subscribers and Internal Messaging

Any information (including personal information) provided in a user profile, member directory, or other related Service should be considered to be available to the public. We do not, cannot, and will not act to maintain the privacy of any information (including personal information) that you provide in any such forum or medium.

Disclosure to Authorities and Legal Requests

SCALIBIT may disclose Customer Data, Service Details, account information, or associated IP address data to competent authorities or legally authorized bodies — including but not limited to law enforcement agencies, prosecutor’s offices, courts, or data protection regulators — when such disclosure is required to comply with applicable laws, regulations, or enforceable legal requests. All disclosures are handled strictly within the scope of the law, upon receipt of an official and verifiable request, and limited to the minimum necessary information to fulfill the legal obligation. SCALIBIT carefully reviews each request to ensure that it is lawful, proportionate, and specific in scope.

Unless prohibited by law or court order, SCALIBIT will make reasonable efforts to notify the affected Customer prior to any disclosure, particularly where the Customer’s data or account may be directly impacted by such request. We maintain detailed records of such disclosures to ensure transparency and accountability in accordance with applicable privacy legislation.

Disclosure of Personal Information to Third Parties

We may disclose personal data about Site visitors, users of our Services, or our suppliers or customers to our affiliates, service providers, and third parties as permitted or required by law, and for the following legitimate business purposes:

• To identify, contact, or bring legal action against someone who may be violating our Terms of Service, Acceptable Use Policy, or other user policies.

• To protect ourselves, our subscribers, and the general public, and to enforce our legal rights.

• In the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).

• In connection with certain essential purposes described above (e.g., to comply with legal obligations, prevent fraud).

In addition, information that is passively collected when you use the Site or Services may be disclosed to our online and email advertisers or other third-party vendors we use and who may provide cookies, pixel tags, web beacons, clear GIFs, or other similar technologies for use on the Site or other websites to manage and improve our online and email advertising campaigns.

Children

The Site is not for use by children under the age of 18 years and SCALIBIT does not knowingly collect, store, use or share the personal information of children under 18 years.

IF YOU ARE A CALIFORNIA RESIDENT UNDER THE AGE OF 18, DO NOT SHARE ANY PERSONAL INFORMATION ON THE SITE, IN POSTS OR VIA MESSAGING. If you do post any personal information, you can remove it using Services functionality. This removal may not be complete given the nature of the Internet. How We Store Your Information

We implement reasonable administrative, physical and electronic security measures designed to protect your personal information from unauthorized access. Nevertheless, we cannot guarantee that your personal information will not be accessed, disclosed, altered, or destroyed. We will make any legally required disclosures in the event of a breach of the security, confidentiality, or integrity of your unencrypted electronically stored personal information.

Cross-Border Processing

SCALIBIT operates as a global infrastructure provider, with servers, data centers, and service partners located in multiple jurisdictions — including the United States, Europe, and Asia. Accordingly, your personal information may be transferred to, stored, or processed in countries other than your own state of residence.

Such transfers are performed for legitimate business purposes, such as providing Services, technical support, billing, security monitoring, and compliance operations. By using our Services, creating an account, or communicating with us, you consent to the transfer of your personal information across international borders in accordance with this Notice.

Where applicable, SCALIBIT applies appropriate organizational and technical measures to ensure that cross-border data processing maintains an adequate level of protection, consistent with applicable privacy laws, including the EU General Data Protection Regulation (GDPR), the UK GDPR, and the Turkish Law on the Protection of Personal Data (KVKK).

SCALIBIT remains committed to transparency and ensures that all users in the United States are informed about how and where their personal data may be processed, stored, or transferred as part of its global infrastructure operations.

The Site may contain links to third party sites which are provided for your convenience only. SCALIBIT does not control and is not responsible for the privacy practices of those third party sites, and we encourage you to review the privacy policies of such sites.

Marketing Emails

If you have provided us with your email address, or are a subscriber of the Services, we may communicate with you by e-mail to tell you about our products and services. You may opt out of these communications by clicking the opt-out link at the bottom of each email or by filling out the form at https://www.scalibit.com/contact-us/. Please note that you may not be able to opt-out of certain Service-related emails, system notices, and/or other information related to your account.

Targeted Advertising and “Sharing”

We do not sell personal information. We may, however, “share” personal information for cross-context behavioral advertising as defined under certain U.S. state privacy laws. You can manage targeting cookies via our Cookies Policy and, where available, through your browser’s Global Privacy Control (GPC) signal, which we endeavor to honor.

If you are a resident of a U.S. state not explicitly listed above, SCALIBIT will extend comparable privacy protections consistent with applicable U.S. data protection laws.

Appeal Process (Non-California States)

If we deny your privacy request, you may appeal our decision by emailing privacy@scalibit.com with “Privacy Appeal” in the subject line and a brief explanation. We will review and respond within the timeframe required by applicable law.

US State Consumer Rights

The privacy laws of the U.S. states listed in this Notice (including CCPA, CPA, VCDPA, etc.) provide consumers with certain rights regarding their personal information. These rights generally include the right to know (access/portability), the right to delete, the right to correct, and the right to opt-out of the sale or sharing of personal information.

Do Not Sell or Share. You have the right to opt-out of the "sale" or "sharing" of your personal information for cross-context behavioral advertising. We will not sell your Personal Information to third parties. You may manage sharing via our Cookies Policy and the Global Privacy Control (GPC) signal.

Non-Discrimination. You have the right to exercise your rights described above free from discriminatory practices prohibited by state law.

You may use an authorized agent to submit a request on your behalf. We will require the agent to provide proof of authorization and will take steps to verify your identity directly, consistent with applicable law. We use reasonable methods to verify requests, which may vary depending on the sensitivity of the data at issue.

We will respond to requests that comply with applicable law within the timeframe permitted and depending on the nature of the request.

Changes to this US States Privacy Notice

We may revise, amend, or modify this US States Privacy Notice from time to time. Please reference the “Last Updated” legend at the top of this page to see when it was last revised. Any changes to this Notice will become effective as to U.S. residents when we post the revised version on the Site. Your continued use of the Site or Services following these changes means that you accept the revised Notice.
